Sección Preliminar
Definiciones y aceptación
Para efectos de esta licencia, se entenderá por:
- Herramienta: AMUKI MODULAR. Visual Construction System. Versión 0.10, incluyendo su código propio, arquitectura técnica, estructura funcional, interfaz, lógica interna, sistemas de interacción, documentación propia y archivos complementarios específicamente integrantes de esta versión.
No forman parte de la Herramienta los materiales o componentes de terceros entregados de manera independiente, incluido el archivo original P_2_3_6_02.pde y la copia de la Apache License, Version 2.0, cuya autoría y régimen de licencia se regulan separadamente en la Cláusula Primera.
- Persona usuaria: persona natural que recibe y utiliza individualmente AMUKI MODULAR. Visual Construction System. Versión 0.10 bajo una licencia válida otorgada por Vanessa Zúñiga Tinizaray, ya sea como participante del Taller “Modularidad con Processing. Nivel I” o mediante la adquisición directa de una licencia individual por otra modalidad autorizada por la autora.
- Contenido incorporado por la persona usuaria: cualquier módulo, imagen, archivo SVG, tipografía, texto, recurso gráfico, audiovisual, digital o cualquier otro contenido que la persona usuaria importe, cargue, incorpore o utilice mediante AMUKI MODULAR. Visual Construction System. Versión 0.10 será responsabilidad exclusiva de dicha persona usuaria.
La persona usuaria será responsable de contar con los derechos de autor, licencias, permisos, autorizaciones o demás derechos necesarios para utilizar los contenidos que incorpore a AMUKI MODULAR. Visual Construction System. Versión 0.10.
Vanessa Zúñiga Tinizaray no verifica, controla ni garantiza la titularidad, procedencia, licitud o condiciones de licencia de los contenidos incorporados por las personas usuarias y no asume responsabilidad por infracciones de derechos de autor, derechos conexos, licencias, marcas, derechos de imagen u otros derechos de terceros derivadas del uso no autorizado de dichos contenidos.
La posibilidad técnica de importar, cargar, visualizar, organizar, modificar o utilizar un contenido mediante AMUKI MODULAR. Visual Construction System. Versión 0.10 no implica que Vanessa Zúñiga Tinizaray otorgue, reconozca o garantice derecho alguno sobre dicho contenido.
- Obras finales: resultados gráficos, tipográficos, visuales o compositivos generados por la persona usuaria mediante AMUKI MODULAR. Visual Construction System. Versión 0.10, a partir de sus propias decisiones creativas y de contenidos sobre los que disponga legítimamente de derechos.
- Software no publicado / de distribución limitada: software que no ha sido puesto a disposición del público en general ni distribuido de forma abierta, masiva o indiscriminada por la autora, y cuya entrega se realiza exclusivamente mediante divulgación limitada y controlada a personas determinadas, en el marco de un taller, acuerdo académico, licencia individual o licencia específica previamente negociada y formalizada por escrito.
La entrega de AMUKI MODULAR. Visual Construction System. Versión 0.10 bajo estas condiciones no autoriza a la persona usuaria a reproducirla, redistribuirla, compartirla, publicarla, ponerla a disposición de terceros ni facilitar su acceso mediante copias, enlaces, repositorios, plataformas, servicios digitales u otros medios. Cualquier modalidad de uso que exceda el alcance de la presente licencia individual deberá ser objeto, cuando resulte susceptible de autorización, de una licencia distinta, previamente negociada y formalizada por escrito con Vanessa Zúñiga Tinizaray.
La instalación, ejecución, acceso, uso o aprovechamiento de AMUKI MODULAR. Visual Construction System. Versión 0.10 implica la aceptación expresa, íntegra y sin reservas de la presente licencia. Si la persona usuaria no está de acuerdo con cualquiera de sus términos y condiciones, deberá abstenerse de utilizar AMUKI MODULAR. Visual Construction System. Versión 0.10.
Cláusula Primera
1. Origen, antecedentes y componentes de terceros.
1.1. Antecedente conceptual y técnico inicial
AMUKI MODULAR. Visual Construction System. Versión 0.10 reconoce como antecedente conceptual y técnico inicial el sketch P_2_3_6_02 (archivo P_2_3_6_02.pde), publicado en el marco del proyecto Generative Gestaltung. Creative Coding, de autoría de Hartmut Bohnacker, Benedikt Gross, Julia Laub y Claudius Lazzeroni.
El sketch constituyó una referencia inicial para la exploración de sistemas visuales construidos mediante relaciones de vecindad entre módulos. La implementación actual de AMUKI MODULAR. Visual Construction System. Versión 0.10 ha sido desarrollada posteriormente mediante una arquitectura, estructura funcional, modelo de datos, interfaz, sistemas de interacción y funcionalidades sustancialmente diferenciados respecto de dicho sketch.
1.2. Código original de referencia
El código original correspondiente al sketch P_2_3_6_02 puede consultarse públicamente en:
http://www.generative-gestaltung.de
Asimismo, en el marco del Taller “Modularidad con Processing. Nivel I”, se entrega a sus participantes, como material independiente de referencia, una carpeta denominada P_2_3_6_02, que contiene el archivo original P_2_3_6_02.pde.
La entrega de dicho archivo se realiza de manera separada de AMUKI MODULAR. Visual Construction System. Versión 0.10 y tiene como finalidad permitir la consulta, estudio y utilización independiente del código original conforme a su propia licencia.
1.3. Licencia del código original
De conformidad con los avisos de copyright y licencia incorporados en el archivo original P_2_3_6_02.pde, dicho código se encuentra sujeto a la Apache License, Version 2.0.

Asimismo, una copia del texto de la Apache License, Version 2.0 se entrega dentro de la carpeta P_2_3_6_02, junto con el archivo original P_2_3_6_02.pde.
1.4. Independencia de la Apache License, Version 2.0
Los derechos concedidos sobre el código original P_2_3_6_02 provienen directamente de la Apache License, Version 2.0 y permanecen sujetos a sus términos y condiciones.
La presente licencia de AMUKI MODULAR. Visual Construction System. Versión 0.10 no sustituye, restringe, modifica ni invalida los derechos que la Apache License, Version 2.0 concede sobre dicho código original.
La entrega separada del archivo P_2_3_6_02.pde y de la Apache License, Version 2.0 no implica que AMUKI MODULAR. Visual Construction System. Versión 0.10, en su conjunto, se encuentre sujeta a dicha licencia. Los desarrollos autorales propios de Vanessa Zúñiga Tinizaray se rigen por la presente licencia, sin perjuicio de las condiciones que continúen siendo aplicables al código original y a cualquier componente de terceros incorporado legítimamente en la Herramienta.
1.5. Uso independiente del código original
Cualquier utilización, modificación o redistribución independiente del código original P_2_3_6_02 deberá realizarse conforme a la Apache License, Version 2.0, conservando los avisos de copyright, licencia, atribución y demás condiciones que resulten aplicables.
1.6. Diferenciación respecto del antecedente original
La referencia al sketch P_2_3_6_02 como antecedente conceptual y técnico no implica que AMUKI MODULAR. Visual Construction System. Versión 0.10 reproduzca su arquitectura, organización interna, interfaz, lógica funcional o alcance.
La estructura actual de AMUKI MODULAR. Visual Construction System. Versión 0.10 responde a un proceso posterior de investigación, diseño, experimentación y desarrollo realizado por Vanessa Zúñiga Tinizaray.
1.7. Organización y arquitectura desarrolladas por la autora
La forma en que AMUKI MODULAR. Visual Construction System. Versión 0.10 organiza, administra y relaciona módulos, grupos, sets, slots, estructuras simples y compuestas, sistemas de vinculación, recursos, patrones, colores y demás estructuras funcionales, así como las reglas de interacción y funcionamiento mediante las cuales estos elementos participan en la construcción visual, corresponde a desarrollos realizados posteriormente por Vanessa Zúñiga Tinizaray.
Estas estructuras y relaciones no deben interpretarse como una reproducción de la organización funcional del sketch original, sin perjuicio de los derechos correspondientes al código sujeto a la Apache License, Version 2.0.
1.8. Aportes originales posteriores
Los desarrollos funcionales, ampliaciones, modificaciones, sistemas de interacción, estructuras de organización, interfaz y documentación incorporados por Vanessa Zúñiga Tinizaray en AMUKI MODULAR. Visual Construction System. Versión 0.10, así como la metodología pedagógica propia asociada al Taller “Modularidad con Processing. Nivel I”, se encuentran sujetos a las condiciones establecidas en la presente licencia, en la medida en que constituyan aportes autorales propios y sin afectar los derechos y obligaciones correspondientes a componentes de terceros.
1.9. Componentes de terceros
AMUKI MODULAR. Visual Construction System. Versión 0.10 puede incorporar o utilizar bibliotecas, dependencias, componentes de ejecución u otros recursos de terceros necesarios para determinadas funcionalidades.
Dichos componentes conservan sus respectivas autorías, avisos y condiciones de licencia. Su utilización dentro de AMUKI MODULAR. Visual Construction System. Versión 0.10 no implica transferencia de derechos entre Vanessa Zúñiga Tinizaray y los respectivos autores o titulares de dichos componentes.
1.10. Alcance de la presente licencia
La presente licencia regula exclusivamente los derechos y condiciones de uso que Vanessa Zúñiga Tinizaray se encuentra facultada para establecer respecto de AMUKI MODULAR. Visual Construction System. Versión 0.10 y de sus aportes autorales propios, sin atribuirse derechos sobre código, bibliotecas, dependencias u otros componentes pertenecientes a terceros.
Cláusula Segunda
2. Otorgamiento y beneficiarios de la licencia
2.1. Persona beneficiaria de la licencia
La presente licencia se concede exclusivamente a la persona natural que recibe individualmente AMUKI MODULAR. Visual Construction System. Versión 0.10 mediante una licencia válida otorgada por Vanessa Zúñiga Tinizaray.
La licencia individual podrá obtenerse como parte de la participación en el Taller “Modularidad con Processing. Nivel I” o mediante adquisición directa de la licencia individual por otra modalidad expresamente autorizada por Vanessa Zúñiga Tinizaray.
La modalidad mediante la cual se obtenga la licencia no modifica su carácter individual ni amplía los derechos de uso establecidos en el presente documento.
2.2. Carácter individual de la licencia
La licencia es estrictamente individual y se concede únicamente a la persona usuaria a quien se entrega AMUKI MODULAR. Visual Construction System. Versión 0.10.
La participación en el taller, la adquisición o pago de una licencia, o la recepción de la Herramienta por parte de una persona no genera derechos de uso a favor de otras personas.
2.3. No extensión a terceros
La presente licencia no se extiende automáticamente a terceros, incluyendo, de manera enunciativa y no limitativa:
- estudiantes de la persona usuaria;
- colegas o colaboradores;
- equipos de trabajo;
- grupos de investigación;
- instituciones educativas;
- universidades;
- empresas;
- organizaciones;
- colectivos;
- plataformas educativas;
- laboratorios;
- entidades públicas o privadas.
La existencia de una relación académica, profesional, laboral, institucional o contractual entre la persona usuaria y cualquiera de estos terceros no les concede derecho alguno para instalar, acceder, utilizar, copiar o recibir AMUKI MODULAR. Visual Construction System. Versión 0.10.
2.4. Alcance del otorgamiento
La licencia habilita a la persona usuaria a utilizar AMUKI MODULAR. Visual Construction System. Versión 0.10 dentro de los usos expresamente autorizados en el presente documento.
Todo uso no autorizado expresamente deberá entenderse sujeto a las restricciones y condiciones establecidas en las cláusulas correspondientes de esta licencia.
2.5. Ausencia de relación institucional o representación
El otorgamiento de la presente licencia no crea relación de asociación, representación, sociedad, franquicia, patrocinio, certificación, vínculo institucional ni relación laboral entre Vanessa Zúñiga Tinizaray y la persona usuaria.
Asimismo, la persona usuaria no queda autorizada, por el solo hecho de recibir esta licencia, para representar a Vanessa Zúñiga Tinizaray, actuar en su nombre, presentarse como representante de AMUKI MODULAR. Visual Construction System. Versión 0.10 ni atribuir a la autora respaldo, aval o participación en actividades desarrolladas por dicha persona.
Cláusula Tercera
3. Naturaleza y alcance de la licencia
3.1. Carácter de la licencia
La presente licencia se concede a la persona usuaria con carácter individual, personal, no exclusivo, intransferible y no sublicenciable, exclusivamente para el uso de AMUKI MODULAR. Visual Construction System. Versión 0.10, conforme a los términos y condiciones establecidos en este documento.
La concesión de esta licencia constituye únicamente una autorización de uso y no implica venta, cesión, transferencia de propiedad intelectual ni transmisión de derechos patrimoniales sobre AMUKI MODULAR. Visual Construction System. Versión 0.10.
3.2. Equipos autorizados
La persona usuaria podrá instalar y utilizar AMUKI MODULAR. Visual Construction System. Versión 0.10 en un máximo de dos (2) equipos de uso personal bajo su control, por ejemplo, una computadora de escritorio y una computadora portátil.
Asimismo, podrá conservar una (1) copia de respaldo exclusivamente con fines de seguridad, recuperación o reinstalación.
La copia de respaldo no constituye una licencia adicional y no podrá ser utilizada por otra persona.
3.3. Uso exclusivamente personal
El acceso y uso de AMUKI MODULAR. Visual Construction System. Versión 0.10 corresponde exclusivamente a la persona usuaria titular de la licencia.
En consecuencia, la persona usuaria no podrá compartir, prestar, ceder, transferir, alquilar, arrendar, entregar, proporcionar acceso ni permitir el uso de AMUKI MODULAR. Visual Construction System. Versión 0.10 a terceros, independientemente de que dicho acceso sea gratuito o remunerado, temporal o permanente.
3.4. Prohibición de uso compartido o colectivo
La licencia individual no autoriza la instalación o utilización de AMUKI MODULAR. Visual Construction System. Versión 0.10 mediante una única licencia en equipos destinados al uso compartido por varias personas, aulas, laboratorios, instituciones, organizaciones, empresas, colectivos, plataformas educativas, servidores u otros entornos de acceso colectivo.
El uso de AMUKI MODULAR. Visual Construction System. Versión 0.10 en contextos docentes o institucionales deberá realizarse conforme a las condiciones establecidas en la Cláusula Octava de la presente licencia.
3.5. Derechos no concedidos
La presente licencia no concede a la persona usuaria derechos para reproducir con fines de distribución, redistribuir, publicar, comunicar públicamente, comercializar, sublicenciar, poner a disposición de terceros o explotar colectivamente AMUKI MODULAR. Visual Construction System. Versión 0.10, total o parcialmente, salvo mediante una licencia distinta, previamente negociada y formalizada por escrito con Vanessa Zúñiga Tinizaray.
Esta limitación se refiere exclusivamente a AMUKI MODULAR. Visual Construction System. Versión 0.10 y a los elementos sobre los cuales Vanessa Zúñiga Tinizaray se encuentre facultada para establecer condiciones de uso, sin afectar los derechos que correspondan independientemente sobre componentes de terceros sujetos a sus respectivas licencias.
3.6. Ausencia de licencia implícita
Ninguna disposición de la presente licencia deberá interpretarse como concesión implícita de derechos distintos de los expresamente establecidos.
La adquisición, recepción, instalación o utilización de AMUKI MODULAR. Visual Construction System. Versión 0.10 no concede derechos de propiedad sobre la Herramienta, su arquitectura, interfaz, documentación, metodología pedagógica ni demás aportes autorales propios de Vanessa Zúñiga Tinizaray.
Cláusula Cuarta
4. Autoría, desarrollos propios y diferenciación respecto del antecedente original
4.1. Diferenciación respecto del código original
AMUKI MODULAR. Visual Construction System. Versión 0.10 no constituye una reproducción literal del sketch P_2_3_6_02, ni conserva como estructura funcional propia la arquitectura, interfaz, organización o alcance limitado del código original.
El sketch P_2_3_6_02 constituye el antecedente conceptual y técnico reconocido en la Cláusula Primera. A partir de dicho antecedente, Vanessa Zúñiga Tinizaray desarrolló progresivamente una arquitectura de construcción visual con estructuras, relaciones, sistemas de interacción, mecanismos de organización y funcionalidades propias.
4.2. Desarrollo de una arquitectura propia
La arquitectura actual de AMUKI MODULAR. Visual Construction System. Versión 0.10 responde a un proceso continuado de investigación, diseño, experimentación y desarrollo realizado por Vanessa Zúñiga Tinizaray.
En particular, la forma en que los diferentes elementos de la Herramienta se organizan, relacionan, vinculan, administran y utilizan dentro del proceso de construcción visual corresponde a decisiones de diseño y desarrollo incorporadas progresivamente por la autora.
4.3. Aportes autorales propios
Sin perjuicio de los derechos correspondientes al código original y a otros componentes de terceros, forman parte de los desarrollos propios de Vanessa Zúñiga Tinizaray vinculados a AMUKI MODULAR. Visual Construction System. Versión 0.10 y, cuando corresponda, a su contexto pedagógico de uso:
- a) la arquitectura general del sistema de construcción visual;
- b) la organización funcional, estructuración y relaciones entre módulos, grupos, sets, slots y demás estructuras que integran la Herramienta;
- c) la organización y funcionamiento de estructuras simples, compuestas, vinculadas y demás configuraciones disponibles en esta versión;
- d) las reglas, mecanismos y sistemas mediante los cuales los distintos elementos de la Herramienta se seleccionan, relacionan, vinculan, transforman, organizan y utilizan durante el proceso de construcción visual;
- e) los modos y sistemas de interacción implementados en esta versión;
- f) la organización y funcionamiento de los sistemas de Grid y sus relaciones con los elementos de construcción visual;
- g) los mecanismos de organización, utilización y administración de recursos incorporados a la Herramienta;
- h) los sistemas de gestión de patrones, color y demás propiedades visuales;
- i) la estructura de interacción y funcionamiento de la interfaz gráfica;
- j) los mecanismos de selección, transformación, manipulación y composición visual;
- k) los sistemas de gestión de capas y de los contenidos que integran una composición;
- l) los mecanismos de persistencia, guardado, carga y recuperación de proyectos disponibles en esta versión;
- m) las funcionalidades de importación y exportación implementadas en esta versión;
- n) la documentación desarrollada específicamente para la Herramienta;
- o) y la metodología pedagógica desarrollada por Vanessa Zúñiga Tinizaray para el Taller “Modularidad con Processing. Nivel I”.
La presente enumeración tiene carácter descriptivo y no limitativo y deberá interpretarse exclusivamente respecto de los elementos efectivamente desarrollados por Vanessa Zúñiga Tinizaray, sin afectar los derechos correspondientes a código, bibliotecas, dependencias, conceptos generales, formatos, recursos o componentes pertenecientes a terceros.
4.4. Derechos sobre los aportes propios
Los derechos que correspondan sobre el código propio, arquitectura funcional, organización del sistema, interfaz, documentación, materiales propios y demás desarrollos originales identificados en la presente cláusula pertenecen a Vanessa Zúñiga Tinizaray, de conformidad con la legislación aplicable y sin perjuicio de los derechos correspondientes a terceros.
La entrega de AMUKI MODULAR. Visual Construction System. Versión 0.10 a la persona usuaria no implica cesión, transferencia ni renuncia de dichos derechos.
4.5. Elementos no reclamados como autoría exclusiva
La presente licencia no pretende atribuir a Vanessa Zúñiga Tinizaray derechos exclusivos sobre ideas abstractas, principios generales de modularidad, conceptos matemáticos, formas geométricas básicas, métodos generales de diseño, lenguajes de programación, formatos de archivo, bibliotecas, dependencias, código perteneciente a terceros ni otros elementos que, por su naturaleza o régimen jurídico, no sean susceptibles de apropiación exclusiva por la autora.
La protección establecida en esta licencia se refiere a los desarrollos concretos y originales incorporados por Vanessa Zúñiga Tinizaray en AMUKI MODULAR. Visual Construction System. Versión 0.10.
4.6. Autonomía de los contenidos creados por la persona usuaria
La utilización de las estructuras funcionales de AMUKI MODULAR. Visual Construction System. Versión 0.10 no convierte a Vanessa Zúñiga Tinizaray en autora o coautora de los módulos, grupos, sets, composiciones, patrones u obras originales creadas posteriormente por la persona usuaria.
Los derechos sobre dichas creaciones se determinarán de conformidad con su respectiva autoría y con lo establecido en las cláusulas posteriores de la presente licencia.
4.7. Independencia respecto de componentes de terceros
La titularidad sobre los desarrollos propios identificados en esta cláusula no afecta ni modifica los derechos correspondientes a autores, titulares o licenciantes de código, bibliotecas, dependencias, recursos u otros componentes de terceros utilizados por AMUKI MODULAR. Visual Construction System. Versión 0.10.
Del mismo modo, la utilización legítima de dichos componentes de terceros no implica cesión de derechos sobre los desarrollos propios realizados por Vanessa Zúñiga Tinizaray.
Cláusula Quinta
5. Uso académico, investigación y publicaciones
5.1. Uso académico autorizado
Se autoriza expresamente a la persona usuaria a utilizar AMUKI MODULAR. Visual Construction System. Versión 0.10 en procesos individuales de producción académica, investigación, experimentación y creación, incluyendo:
- a) artículos científicos, académicos y pedagógicos;
- b) tesis de grado y posgrado;
- c) trabajos de titulación;
- d) ponencias, conferencias y comunicaciones académicas;
- e) proyectos de investigación;
- f) investigaciones metodológicas, didácticas, visuales o experimentales;
- g) documentación académica de procesos creativos;
- h) y otras producciones intelectuales equivalentes.
5.2. Obligación de atribución académica
Toda publicación, investigación, tesis, comunicación académica o producción intelectual que utilice AMUKI MODULAR. Visual Construction System. Versión 0.10 como parte sustancial de su metodología, proceso experimental, producción o construcción visual deberá reconocer expresamente la herramienta utilizada.
La atribución deberá identificar, como mínimo, a Vanessa Zúñiga Tinizaray como autora de AMUKI MODULAR. Visual Construction System. Versión 0.10, el nombre completo de la herramienta y la versión utilizada.
5.3. Referencias académicas
Para la atribución académica de AMUKI MODULAR. Visual Construction System. Versión 0.10 deberá utilizarse la referencia correspondiente a la Herramienta indicada en el apartado 2 de este numeral.
La referencia al sketch original P_2_3_6_02 y a sus autores corresponderá cuando el trabajo académico, investigación o publicación utilice, analice, documente o mencione específicamente dicho código original o su condición de antecedente conceptual y técnico.

Visual Construction System. Versión 0.10 y la identificación de la versión utilizada.
5.4. Independencia entre atribución y autoría de los resultados
La obligación de citar AMUKI MODULAR. Visual Construction System. Versión 0.10 no atribuye a Vanessa Zúñiga Tinizaray autoría ni coautoría sobre los trabajos académicos, investigaciones, composiciones u obras originales desarrollados por la persona usuaria.
Del mismo modo, la autoría de los resultados producidos por la persona usuaria no concede a dicha persona derechos sobre AMUKI MODULAR. Visual Construction System. Versión 0.10, su código propio, arquitectura funcional, interfaz, documentación, metodología pedagógica ni demás aportes autorales protegidos por la presente licencia.
5.5. Límites del uso académico autorizado
El permiso establecido en esta cláusula se refiere exclusivamente al uso de AMUKI MODULAR. Visual Construction System. Versión 0.10 como herramienta dentro de procesos individuales de producción académica, investigación y creación.
Este permiso no implica, bajo ninguna circunstancia:
- a) autorización para reproducir o redistribuir AMUKI MODULAR. Visual Construction System. Versión 0.10;
- b) autorización para compartir copias, archivos de instalación, código o mecanismos de acceso con otras personas;
- c) autorización para poner AMUKI MODULAR. Visual Construction System. Versión 0.10 a disposición de estudiantes, instituciones, equipos de investigación o terceros;
- d) autorización para incorporar AMUKI MODULAR. Visual Construction System. Versión 0.10 en repositorios, plataformas educativas, servidores u otros sistemas de distribución;
- e) autorización, por sí sola, para utilizar AMUKI MODULAR. Visual Construction System. Versión 0.10 como recurso docente para terceros;
- f) autorización, por sí sola, para impartir cursos, talleres, asignaturas, capacitaciones u otros procesos formativos utilizando AMUKI MODULAR. Visual Construction System. Versión 0.10. El uso docente se regirá por las condiciones establecidas en la Cláusula Octava;
- g) ni cesión total o parcial de derechos sobre los aportes autorales propios de Vanessa Zúñiga Tinizaray.
5.6. Usos académicos que involucren a terceros
La utilización de AMUKI MODULAR. Visual Construction System. Versión 0.10 dentro de un artículo, tesis, investigación o proyecto académico individual no extiende la licencia a otras personas participantes en dicho proyecto.
Cuando otras personas necesiten instalar, ejecutar o utilizar directamente AMUKI MODULAR. Visual Construction System. Versión 0.10, cada una deberá disponer de su propia licencia individual válida o encontrarse comprendida en una modalidad de licencia específica previamente negociada y formalizada por escrito con Vanessa Zúñiga Tinizaray.
5.7. Uso docente
La utilización de AMUKI MODULAR. Visual Construction System. Versión 0.10 en procesos de docencia, enseñanza, capacitación o formación de terceros se regirá específicamente por lo establecido en la Cláusula Octava de la presente licencia.
Cláusula Sexta
6. Materiales del taller, contenidos pedagógicos y ejemplos
6.1. Materiales asociados al taller
La presentación, ejercicios, consignas, secuencias didácticas, archivos de apoyo, esquemas explicativos, documentos y demás materiales proporcionados o utilizados durante el Taller “Modularidad con Processing. Nivel I” pueden incluir tanto contenidos desarrollados por Vanessa Zúñiga Tinizaray como materiales de terceros utilizados legítimamente con fines de referencia, explicación, análisis o contextualización.
La inclusión de materiales de terceros dentro de la presentación no implica atribución de autoría a Vanessa Zúñiga Tinizaray. Dichos materiales mantienen la autoría, procedencia y condiciones de uso que correspondan a sus respectivos titulares.
6.2. Protección de los materiales pedagógicos
Los materiales desarrollados por Vanessa Zúñiga Tinizaray para el Taller “Modularidad con Processing. Nivel I” permanecen sujetos a los derechos de autor y demás derechos que correspondan conforme a la legislación aplicable.
La entrega o acceso a dichos materiales permite exclusivamente su consulta y utilización personal por parte de la persona usuaria como apoyo a su aprendizaje, experimentación y práctica individual vinculados al Taller “Modularidad con Processing. Nivel I”.
Su entrega no implica cesión, transferencia ni autorización general para su reproducción, adaptación, redistribución, publicación o utilización en procesos formativos dirigidos a terceros.
6.3. Ejemplos utilizados en la presentación
En la parte inicial del Taller “Modularidad con Processing. Nivel I”, la presentación incorpora ejemplos procedentes del proyecto Generative Gestaltung. Creative Coding, de Hartmut Bohnacker, Benedikt Gross, Julia Laub y Claudius Lazzeroni, utilizados para explicar y contextualizar el funcionamiento del sketch original de referencia P_2_3_6_02 y los principios de organización modular asociados a dicho antecedente.
La autoría de estos ejemplos corresponde a sus respectivos autores y su utilización dentro del taller no implica que Vanessa Zúñiga Tinizaray reivindique derechos de autor sobre ellos.
Posteriormente, la presentación incorpora tres (3) ejemplos propios procedentes del proyecto de investigación Crónicas Visuales del Abya Yala, desarrollados por Vanessa Zúñiga Tinizaray y utilizados exclusivamente para mostrar aplicaciones, procesos y posibilidades de construcción visual dentro del contexto del taller.
Estos tres ejemplos mantienen su autoría y protección independiente y no podrán ser reproducidos, redistribuidos, reutilizados como ejercicios modelo ni incorporados como material de enseñanza por la persona usuaria sin autorización expresa, previa y por escrito de Vanessa Zúñiga Tinizaray.
6.4. Uso personal autorizado
La persona usuaria podrá consultar y utilizar los materiales entregados durante el Taller “Modularidad con Processing. Nivel I” como apoyo para su propio aprendizaje, experimentación y práctica personal con AMUKI MODULAR. Visual Construction System. Versión 0.10.
Este permiso no se extiende a su utilización como material destinado a enseñar, capacitar o formar a otras personas.
6.5. Usos no autorizados
Sin autorización expresa, previa y por escrito de Vanessa Zúñiga Tinizaray, la persona usuaria no podrá:
- a) reproducir total o sustancialmente la presentación del taller;
- b) redistribuir los ejercicios, consignas, archivos de apoyo, esquemas, ejemplos u otros materiales proporcionados;
- c) utilizar dichos materiales para impartir clases, cursos, talleres, seminarios, capacitaciones, asignaturas u otros procesos formativos;
- d) incorporar los contenidos, estructura o secuencia pedagógica del taller como material curricular propio;
- e) presentar como propios los ejercicios, ejemplos, materiales, recursos o estructuras pedagógicas desarrollados por Vanessa Zúñiga Tinizaray;
- f) utilizar contenidos de Crónicas Visuales del Abya Yala como material base para ejercicios, demostraciones o procesos de enseñanza dirigidos a terceros;
- g) proporcionar copias completas o sustanciales de los materiales del taller a otras personas, instituciones o plataformas.
6.6. Citas, referencias y materiales de terceros
La persona usuaria deberá respetar la autoría y procedencia de los diferentes contenidos mostrados durante el taller.
Cuando se haga referencia a ejemplos, imágenes, código u otros materiales procedentes de Generative Gestaltung. Creative Coding o de cualquier otra fuente externa, deberán respetarse las condiciones de atribución, licencia y utilización establecidas por sus respectivos autores o titulares.
Respecto de los materiales originales desarrollados por Vanessa Zúñiga Tinizaray para el Taller “Modularidad con Processing. Nivel I”, podrán utilizarse citas textuales breves, referencias puntuales o fragmentos limitados con fines legítimos de análisis, investigación o comunicación académica, siempre que:
- a) se identifique correctamente a Vanessa Zúñiga Tinizaray como autora;
- b) se indique la procedencia del material;
- c) no se reproduzca una parte sustancial de la presentación o de los materiales originales;
- d) no se redistribuya la presentación completa ni otros materiales completos;
- e) y dicha utilización no permita sustituir o reconstruir sustancialmente el material original.
Los tres (3) ejemplos procedentes de Crónicas Visuales del Abya Yala estarán sujetos además a las restricciones específicas establecidas en el numeral 6.3 de la presente licencia.
6.7. Desarrollo independiente de materiales docentes
La participación en el Taller “Modularidad con Processing. Nivel I” no impide que la persona usuaria desarrolle posteriormente sus propios ejercicios, ejemplos, contenidos, actividades o materiales relacionados con modularidad, diseño, programación u otros campos afines, siempre que sean desarrollados de manera independiente y no reproduzcan, adapten sustancialmente, redistribuyan o reutilicen sin autorización los materiales pedagógicos desarrollados por Vanessa Zúñiga Tinizaray.
La presente disposición, por sí sola, no concede autorización para utilizar AMUKI MODULAR. Visual Construction System. Versión 0.10 en procesos de enseñanza, capacitación o formación dirigidos a terceros. El uso docente de la Herramienta estará sujeto a las condiciones específicas establecidas en la Cláusula Octava de la presente licencia.
Para fines docentes, la persona usuaria podrá recurrir de manera independiente al sketch original P_2_3_6_02, archivo P_2_3_6_02.pde, perteneciente al proyecto Generative Gestaltung. Creative Coding, de autoría de Hartmut Bohnacker, Benedikt Gross, Julia Laub y Claudius Lazzeroni, siempre que su utilización se realice conforme a la Apache License, Version 2.0, incluidos los avisos de autoría, copyright, licencia y demás condiciones aplicables.
El permiso de utilización del código original P_2_3_6_02 deriva exclusivamente de la Apache License, Version 2.0 y es independiente de la presente licencia. En consecuencia, dicho permiso no se extiende a AMUKI MODULAR. Visual Construction System. Versión 0.10, ni a su código propio, arquitectura, interfaz, sistemas de interacción, documentación, metodología pedagógica o demás desarrollos realizados por Vanessa Zúñiga Tinizaray.
Las condiciones específicas para utilizar AMUKI MODULAR. Visual Construction System. Versión 0.10 en contextos docentes se establecen en la Cláusula Octava de la presente licencia.
6.8. Independencia entre los materiales del taller y la licencia de la Herramienta
El acceso a los materiales pedagógicos del Taller “Modularidad con Processing. Nivel I” no amplía los derechos concedidos sobre AMUKI MODULAR. Visual Construction System. Versión 0.10.
Del mismo modo, disponer de una licencia individual de AMUKI MODULAR. Visual Construction System. Versión 0.10 no concede automáticamente autorización para reproducir, reutilizar, redistribuir o enseñar mediante los materiales pedagógicos proporcionados durante el taller.
El uso de AMUKI MODULAR. Visual Construction System. Versión 0.10 en procesos de docencia o formación de terceros se regirá específicamente por la Cláusula Octava de la presente licencia.
6.9. Adquisición de la licencia sin participación en el taller
La adquisición directa de una licencia individual de AMUKI MODULAR. Visual Construction System. Versión 0.10 sin participación en el Taller “Modularidad con Processing. Nivel I” no incluye ni genera derecho de acceso a la presentación, ejercicios, consignas, secuencias didácticas, archivos de apoyo, ejemplos, documentos, materiales pedagógicos ni demás contenidos proporcionados o utilizados en dicho taller.
La licencia sobre la Herramienta y el acceso a los materiales del taller constituyen derechos y prestaciones independientes. La adquisición de una licencia individual de AMUKI MODULAR. Visual Construction System. Versión 0.10 no implica adquisición, licencia ni autorización de uso sobre los materiales pedagógicos del Taller “Modularidad con Processing. Nivel I”, salvo que estos hayan sido proporcionados expresamente a la persona usuaria en el marco de su participación en dicho taller.
Cláusula Séptima
7. Permisos, usos autorizados y derechos de la persona usuaria
7.1. Permiso individual de uso
7.1.1. En el marco de la presente licencia, Vanessa Zúñiga Tinizaray autoriza a la persona usuaria, de forma limitada, personal, individual y no exclusiva, a utilizar AMUKI MODULAR. Visual Construction System. Versión 0.10 conforme a los términos, condiciones, permisos y restricciones establecidos en este documento.
7.1.2. Los permisos concedidos mediante esta licencia corresponden exclusivamente a la persona usuaria titular de la misma y no se extienden a terceros.
7.2. Alcance de los permisos concedidos
7.2.1. La persona usuaria podrá utilizar AMUKI MODULAR. Visual Construction System. Versión 0.10 para fines personales, académicos, experimentales, creativos, de investigación y producción visual.
7.2.2. Asimismo, podrá explorar, diseñar y desarrollar sus propios módulos, grupos, sets, composiciones, patrones, configuraciones y sistemas visuales mediante las funcionalidades disponibles en AMUKI MODULAR. Visual Construction System. Versión 0.10.
7.2.3. La persona usuaria podrá importar a AMUKI MODULAR. Visual Construction System. Versión 0.10 los recursos y contenidos compatibles con las funcionalidades disponibles en la Herramienta, siempre que disponga de los derechos, licencias o autorizaciones necesarios cuando dichos contenidos pertenezcan a terceros.
7.2.4. La persona usuaria podrá guardar, recuperar y exportar sus proyectos y resultados mediante las funcionalidades y formatos disponibles en AMUKI MODULAR. Visual Construction System. Versión 0.10.
7.3. Creación de sistemas y resultados propios
7.3.1. La utilización de AMUKI MODULAR. Visual Construction System. Versión 0.10 permite a la persona usuaria desarrollar sistemas visuales y composiciones originales mediante sus propias decisiones de selección, organización, relación, transformación y construcción.
7.3.2. La utilización de las estructuras funcionales, modos, relaciones y mecanismos de construcción proporcionados por AMUKI MODULAR. Visual Construction System. Versión 0.10 no convierte a Vanessa Zúñiga Tinizaray en autora o coautora de las creaciones originales desarrolladas por la persona usuaria.
7.4. Derechos sobre las obras finales
7.4.1. Las obras finales originales creadas por la persona usuaria mediante AMUKI MODULAR. Visual Construction System. Versión 0.10 pertenecen a dicha persona en la medida en que deriven de sus propias decisiones creativas y de contenidos sobre los cuales disponga legítimamente de los derechos necesarios.
7.4.2. En consecuencia, la persona usuaria podrá exhibir, publicar, reproducir, difundir, licenciar y comercializar sus obras finales sin requerir autorización adicional de Vanessa Zúñiga Tinizaray.
7.4.3. La creación de una obra final mediante AMUKI MODULAR. Visual Construction System. Versión 0.10 no genera por sí misma coautoría, participación patrimonial ni derecho de propiedad alguno a favor de Vanessa Zúñiga Tinizaray sobre dicha obra.
7.4.4. El reconocimiento de los derechos de la persona usuaria sobre sus obras finales no implica transferencia de derechos sobre AMUKI MODULAR. Visual Construction System. Versión 0.10.
Cuando la obra final sea presentada, publicada, documentada o comunicada en un contexto académico, investigativo, expositivo o profesional en el que resulte pertinente identificar el proceso o las herramientas utilizadas, deberá reconocerse que fue desarrollada mediante AMUKI MODULAR. Visual Construction System. Versión 0.10, conforme a las disposiciones de atribución establecidas en la Cláusula Quinta de la presente licencia.
Dicho reconocimiento identifica la herramienta utilizada en el proceso de creación y no implica autoría, coautoría ni participación de Vanessa Zúñiga Tinizaray sobre la obra final de la persona usuaria.
7.5. Contenidos de terceros incorporados por la persona usuaria
7.5.1. Cuando una obra final incorpore imágenes, tipografías, archivos SVG, textos, videos, recursos gráficos, audiovisuales, digitales u otros contenidos pertenecientes a terceros, la persona usuaria será exclusivamente responsable de disponer de los derechos, licencias, permisos o autorizaciones necesarios para utilizarlos, transformarlos, reproducirlos, publicarlos o comercializarlos.
7.5.2. La utilización técnica de dichos contenidos mediante AMUKI MODULAR. Visual Construction System. Versión 0.10 no concede a la persona usuaria derechos adicionales sobre ellos ni modifica las condiciones establecidas por sus respectivos autores, titulares o licencias.
7.5.3. Vanessa Zúñiga Tinizaray no determina, verifica ni garantiza que los contenidos incorporados por la persona usuaria puedan ser legítimamente utilizados, publicados, transformados, distribuidos o comercializados.
7.6. Exclusiones respecto de los permisos concedidos
7.6.1. Los permisos reconocidos a la persona usuaria sobre sus creaciones y obras finales no se extienden a:
- a) AMUKI MODULAR. Visual Construction System. Versión 0.10 en sí misma;
- b) el código propio desarrollado por Vanessa Zúñiga Tinizaray;
- c) la arquitectura funcional de la Herramienta;
- d) su interfaz y sistemas de interacción;
- e) su documentación;
- f) la metodología pedagógica asociada;
- g) los materiales originales proporcionados durante el Taller “Modularidad con Processing. Nivel I”;
- h) los tres ejemplos procedentes de Crónicas Visuales del Abya Yala incluidos en la presentación del taller;
- i) ni cualquier otro contenido propio de Vanessa Zúñiga Tinizaray protegido conforme a la presente licencia.
7.6.2. Los derechos y condiciones aplicables al código original P_2_3_6_02 y a otros componentes pertenecientes a terceros continuarán determinados por sus respectivas licencias y no por las exclusiones establecidas en el numeral anterior.
7.7. No cesión de derechos sobre AMUKI MODULAR. Visual Construction System. Versión 0.10
7.7.1. La presente licencia no implica cesión ni transferencia de los derechos que correspondan a Vanessa Zúñiga Tinizaray sobre AMUKI MODULAR. Visual Construction System. Versión 0.10.
7.7.2. En particular, los derechos concedidos para utilizar AMUKI MODULAR. Visual Construction System. Versión 0.10 y crear obras mediante ella no constituyen autorización para reproducirla con fines de distribución, redistribuirla, sublicenciarla, ponerla a disposición de terceros, comercializarla, explotarla como software ni utilizarla bajo modalidades distintas de las expresamente contempladas en la presente licencia individual.
Cualquier uso que exceda el alcance de la presente licencia deberá ser objeto de una licencia distinta, previamente negociada y formalizada por escrito con Vanessa Zúñiga Tinizaray, en la que se establecerán específicamente las condiciones, alcance, duración, número de personas usuarias, modalidad de utilización y, cuando corresponda, la contraprestación económica aplicable.
La celebración de dicha licencia adicional no constituye un derecho adquirido de la persona usuaria ni una obligación de Vanessa Zúñiga Tinizaray de concederla.
Lo anterior se entiende sin perjuicio de los derechos independientes que correspondan sobre componentes de terceros sujetos a sus respectivas licencias.
7.8. Autonomía entre la Herramienta y la obra resultante
7.8.1. AMUKI MODULAR. Visual Construction System. Versión 0.10 constituye un medio para la construcción y producción visual.
7.8.2. El uso legítimo de AMUKI MODULAR. Visual Construction System. Versión 0.10 no transfiere derechos sobre la Herramienta a la persona usuaria y, de manera recíproca, la utilización de la Herramienta no transfiere a Vanessa Zúñiga Tinizaray derechos sobre las obras originales creadas por la persona usuaria.
7.9. Interpretación conforme a la presente licencia
7.9.1. Los permisos reconocidos en esta cláusula deberán interpretarse conjuntamente con las demás disposiciones de la presente licencia y no podrán entenderse como autorización para realizar usos expresamente restringidos en otras cláusulas.
7.9.2. Las condiciones específicas relacionadas con docencia, enseñanza y utilización de AMUKI MODULAR. Visual Construction System. Versión 0.10 por estudiantes o terceros se regulan en la Cláusula Octava.
Cláusula Octava
8. Docencia, enseñanza y uso formativo
8.1. Alcance de la licencia individual en contextos docentes
8.1.1. La participación en el Taller “Modularidad con Processing. Nivel I” y la obtención de una licencia individual de AMUKI MODULAR. Visual Construction System. Versión 0.10 no autorizan, por sí mismas, a compartir, distribuir, prestar, reproducir o poner la copia licenciada a disposición de estudiantes, participantes o terceros.
8.1.2. La licencia individual corresponde exclusivamente a su titular. En consecuencia, una persona docente no podrá utilizar su propia copia de AMUKI MODULAR. Visual Construction System. Versión 0.10 como copia colectiva, compartida o común para que otras personas accedan, instalen o utilicen la Herramienta.
8.2. Uso docente del código original de referencia
8.2.1. Las personas interesadas en enseñar contenidos relacionados con modularidad, programación o diseño generativo podrán utilizar de manera independiente el sketch original P_2_3_6_02, archivo P_2_3_6_02.pde, perteneciente al proyecto Generative Gestaltung. Creative Coding, de autoría de Hartmut Bohnacker, Benedikt Gross, Julia Laub y Claudius Lazzeroni, siempre que respeten las condiciones establecidas en la Apache License, Version 2.0, incluidos los avisos de copyright, autoría, licencia y atribución que correspondan.
8.2.2. El derecho a utilizar, modificar o enseñar mediante el código original P_2_3_6_02 deriva exclusivamente de la Apache License, Version 2.0 y es completamente independiente de la presente licencia.
8.2.3. Por consiguiente, el uso docente legítimo del código original P_2_3_6_02 no requiere autorización de Vanessa Zúñiga Tinizaray, siempre que dicho uso se limite al material sujeto a la Apache License, Version 2.0 y se respeten íntegramente sus condiciones.
8.2.4. El permiso establecido por la Apache License, Version 2.0 respecto del código original P_2_3_6_02 no se extiende automáticamente a AMUKI MODULAR. Visual Construction System. Versión 0.10, ni a los desarrollos propios, arquitectura funcional, sistemas de organización, interfaz, documentación, materiales pedagógicos o metodología desarrollados por Vanessa Zúñiga Tinizaray.
8.3. Uso de AMUKI MODULAR. Visual Construction System. Versión 0.10 en procesos docentes
8.3.1. AMUKI MODULAR. Visual Construction System. Versión 0.10 podrá utilizarse como herramienta dentro de un curso, taller, asignatura, seminario u otro proceso formativo cuando cada persona que instale, ejecute o utilice directamente la Herramienta disponga de su propia licencia individual válida, o cuando dicho uso se encuentre expresamente comprendido en una licencia específica previamente negociada y formalizada por escrito con Vanessa Zúñiga Tinizaray.
8.3.2. Cuando el proceso formativo se realice mediante licencias individuales, la licencia individual de una persona docente no cubre ni sustituye las licencias individuales de sus estudiantes o participantes.
8.3.3. En dicha modalidad, cada estudiante o participante que utilice AMUKI MODULAR. Visual Construction System. Versión 0.10 deberá haber obtenido legítimamente su propia licencia y deberá cumplir individualmente los términos y condiciones establecidos en la presente licencia.
8.3.4. La persona docente no podrá proporcionar a sus estudiantes o participantes:
- a) su propia copia de AMUKI MODULAR. Visual Construction System. Versión 0.10;
- b) archivos de instalación correspondientes a su licencia;
- c) carpetas privadas de entrega;
- d) credenciales o mecanismos personales de acceso;
- e) copias del código propio de AMUKI MODULAR. Visual Construction System. Versión 0.10;
- f) ni cualquier otro mecanismo destinado a permitir que varias personas utilicen una única licencia individual.
8.3.5. El hecho de que todas las personas participantes dispongan de una licencia individual válida de AMUKI MODULAR. Visual Construction System. Versión 0.10 permite el uso de la Herramienta dentro del proceso formativo, pero no concede a la persona docente autorización para reproducir, reutilizar o impartir los materiales pedagógicos originales del Taller “Modularidad con Processing. Nivel I”.
8.3.6. En particular, la utilización docente de AMUKI MODULAR. Visual Construction System. Versión 0.10 no autoriza a reproducir o reutilizar la presentación, ejercicios, secuencias didácticas, archivos de apoyo, ejemplos propios, contenidos de Crónicas Visuales del Abya Yala ni otros materiales protegidos desarrollados por Vanessa Zúñiga Tinizaray.
8.3.7. Asimismo, la utilización de AMUKI MODULAR. Visual Construction System. Versión 0.10 en un proceso formativo no convierte a la persona docente en instructora autorizada, formadora oficial, socia, certificadora, distribuidora ni representante de Vanessa Zúñiga Tinizaray, salvo que exista un acuerdo específico, previo y por escrito que establezca expresamente dicha condición.
8.4. Desarrollo de materiales docentes propios
8.4.1. Una persona docente podrá desarrollar sus propios ejercicios, ejemplos, contenidos, actividades y materiales pedagógicos relacionados con modularidad, diseño, programación o construcción visual.
8.4.2. Cuando dichos procesos utilicen AMUKI MODULAR. Visual Construction System. Versión 0.10, deberán respetarse las condiciones de licenciamiento establecidas en los numerales 8.3 y 8.5, según corresponda.
8.4.3. Los materiales desarrollados por la persona docente deberán ser propios e independientes y no podrán consistir en la reproducción, adaptación sustancial, redistribución o reutilización no autorizada de los materiales pedagógicos desarrollados por Vanessa Zúñiga Tinizaray.
8.5. Uso institucional, colectivo o mediante licencias múltiples
8.5.1. Cuando una universidad, institución educativa, empresa, organización, laboratorio, colectivo u otra entidad desee utilizar AMUKI MODULAR. Visual Construction System. Versión 0.10 de forma institucional o colectiva, o adquirir o gestionar múltiples licencias para dicho uso, deberá negociarse y formalizarse previamente una licencia específica con Vanessa Zúñiga Tinizaray.
8.5.2. Se consideran comprendidos dentro de este supuesto, de manera enunciativa y no limitativa:
- a) instalaciones en laboratorios, aulas o equipos de uso compartido;
- b) instalaciones institucionales administradas centralmente;
- c) licencias destinadas a grupos, cursos, cohortes o programas académicos;
- d) utilización de AMUKI MODULAR. Visual Construction System. Versión 0.10 por grupos de estudiantes dentro de procesos de titulación, trabajos de grado, tesis, maestrías, especializaciones, programas de posgrado o doctorado cuando el acceso sea proporcionado, gestionado o financiado colectivamente por una institución, programa, proyecto o grupo;
- e) utilización por grupos o equipos de investigación, proyectos institucionales, laboratorios de investigación, observatorios, semilleros, colectivos académicos u otras unidades de investigación;
- f) utilización conjunta por estudiantes, docentes, tutores, directores de tesis, investigadores, asistentes de investigación u otros participantes de un mismo proyecto cuando el acceso a la Herramienta sea proporcionado, administrado o licenciado de manera colectiva, en lugar de realizarse mediante licencias individuales válidas correspondientes a cada persona usuaria;
- g) distribución institucional de AMUKI MODULAR. Visual Construction System. Versión 0.10 a estudiantes, docentes, investigadores, personal académico o administrativo;
- h) utilización mediante cuentas, equipos, instalaciones o mecanismos de acceso compartido;
- i) incorporación de AMUKI MODULAR. Visual Construction System. Versión 0.10 como recurso permanente o recurrente dentro de un programa académico, carrera, maestría, especialización, doctorado, proyecto de investigación, laboratorio o unidad institucional;
- j) adquisición o gestión de múltiples licencias por parte de una universidad, institución educativa, centro de investigación, empresa, organización o proyecto;
- k) y cualquier otra modalidad de uso que exceda el alcance de una licencia individual.
8.5.3. Uso académico individual en procesos de titulación e investigación
La realización individual de una tesis, trabajo de titulación, investigación de maestría, especialización, posgrado o doctorado mediante AMUKI MODULAR. Visual Construction System. Versión 0.10 no requiere una licencia adicional cuando la persona investigadora dispone de una licencia individual válida y es la única persona que instala y utiliza directamente la Herramienta.
La participación de tutores, directores de tesis, docentes o investigadores en funciones de orientación, revisión o supervisión no exige por sí misma una licencia. Cuando cualquiera de estas personas requiera instalar, ejecutar o utilizar directamente AMUKI MODULAR. Visual Construction System. Versión 0.10, deberá disponer de su propia licencia individual válida o encontrarse comprendida en una modalidad de licencia específica.
8.5.4. La licencia específica deberá establecer, según corresponda, el número de personas usuarias, alcance autorizado, duración, modalidad de acceso, condiciones de instalación, uso docente o institucional y contraprestación económica.
8.5.5. La posibilidad de solicitar una licencia institucional, colectiva o diferente de la licencia individual no constituye un derecho adquirido ni genera obligación para Vanessa Zúñiga Tinizaray de concederla. Sus términos deberán ser previamente acordados y formalizados por escrito.
8.6. Independencia entre enseñanza con el código original y enseñanza con AMUKI MODULAR. Visual Construction System. Versión 0.10
8.6.1. Para evitar cualquier interpretación ambigua, se establece expresamente que existen dos regímenes independientes:
- a) el sketch original P_2_3_6_02, de Hartmut Bohnacker, Benedikt Gross, Julia Laub y Claudius Lazzeroni, podrá utilizarse para fines docentes conforme a la Apache License, Version 2.0;
- b) AMUKI MODULAR. Visual Construction System. Versión 0.10 se encuentra sujeta a la presente licencia y podrá ser utilizada directamente por estudiantes o participantes únicamente cuando cada persona disponga de la licencia correspondiente o cuando exista otra modalidad de licencia previamente negociada y formalizada con Vanessa Zúñiga Tinizaray.
8.6.2. La autorización concedida por la Apache License, Version 2.0 respecto del código original no constituye autorización para reproducir, distribuir, enseñar mediante copias no licenciadas ni poner a disposición de terceros AMUKI MODULAR. Visual Construction System. Versión 0.10.
Cláusula Novena
9. Restricciones y usos no autorizados
9.1. Principio general
Sin perjuicio de los derechos que correspondan sobre el código original P_2_3_6_02 y sobre otros componentes de terceros sujetos a sus respectivas licencias, queda prohibido utilizar AMUKI MODULAR. Visual Construction System. Versión 0.10 o los desarrollos propios de Vanessa Zúñiga Tinizaray de manera distinta a los usos expresamente autorizados en la presente licencia.
Los usos que excedan el alcance de esta licencia individual requerirán, cuando sean susceptibles de autorización, una licencia específica previamente negociada y formalizada por escrito con Vanessa Zúñiga Tinizaray.
9.2. Distribución, cesión y acceso a terceros
La persona usuaria no podrá:
- a) vender, revender, sublicenciar, ceder, compartir, prestar, alquilar, arrendar, regalar o redistribuir AMUKI MODULAR. Visual Construction System. Versión 0.10, total o parcialmente;
- b) proporcionar a terceros copias de instalación, archivos ejecutables, carpetas de entrega, archivos internos, código propio de la autora o cualquier otro componente protegido de AMUKI MODULAR. Visual Construction System. Versión 0.10;
- c) compartir enlaces privados de descarga, credenciales, carpetas, repositorios, servicios de almacenamiento o cualquier otro mecanismo utilizado para acceder a la Herramienta;
- d) permitir que otra persona utilice su licencia individual, aun cuando dicho acceso sea temporal, gratuito o se produzca dentro de una relación familiar, académica, profesional o laboral;
- e) instalar o facilitar el uso de una misma licencia en aulas, laboratorios, equipos compartidos, instituciones, organizaciones o entornos colectivos fuera de las condiciones expresamente permitidas en la presente licencia.
9.3. Publicación y puesta a disposición
La persona usuaria no podrá publicar, alojar, distribuir ni poner a disposición de terceros AMUKI MODULAR. Visual Construction System. Versión 0.10, total o parcialmente, mediante:
- a) repositorios públicos o privados destinados al acceso de terceros;
- b) sitios web;
- c) plataformas educativas;
- d) servicios en la nube;
- e) sistemas de descarga;
- f) aplicaciones;
- g) plugins;
- h) servicios digitales;
- i) plataformas de software;
- j) ni cualquier otro mecanismo de distribución o acceso.
9.4. Modificación y utilización de los desarrollos propios de la autora
La licencia individual no autoriza a la persona usuaria a modificar, adaptar, alterar, sustituir o intervenir el código propio, la arquitectura funcional, las estructuras de organización, la interfaz, los sistemas de interacción, la documentación u otros desarrollos originales de Vanessa Zúñiga Tinizaray incorporados en AMUKI MODULAR. Visual Construction System. Versión 0.10, salvo que exista una licencia específica previamente negociada y formalizada por escrito con Vanessa Zúñiga Tinizaray.
Asimismo, la licencia individual no autoriza a utilizar dichos desarrollos propios, total o parcialmente, para crear, reproducir o desarrollar otra herramienta, aplicación, plataforma, plugin, servicio, sistema de construcción visual o producto de software destinado a terceros.
Tampoco autoriza la redistribución, publicación, puesta a disposición de terceros o comercialización de versiones modificadas de AMUKI MODULAR. Visual Construction System. Versión 0.10.
Lo dispuesto en este numeral no limita ni modifica los derechos que la Apache License, Version 2.0 u otras licencias de terceros concedan directamente respecto de sus propios componentes.
9.5. Plataformas de inteligencia artificial y servicios automatizados
La persona usuaria no podrá proporcionar, cargar, copiar, transmitir, introducir o poner a disposición, total o parcialmente, el código propio, archivos internos, arquitectura interna, documentación protegida u otros componentes protegidos de AMUKI MODULAR. Visual Construction System. Versión 0.10 en:
- a) plataformas o sistemas de inteligencia artificial;
- b) asistentes de programación;
- c) modelos generativos;
- d) servicios automatizados de generación, análisis, transformación, corrección o modificación de código;
- e) servicios destinados al entrenamiento, ajuste o evaluación de modelos;
- f) ni otros servicios de terceros que requieran transmitir, almacenar, procesar o analizar dichos componentes.
Esta restricción comprende tanto la entrega directa del contenido como su utilización dentro de consultas, instrucciones, archivos adjuntos, proyectos, repositorios conectados u otros mecanismos mediante los cuales un tercero o sistema externo pueda acceder al material protegido.
Cualquier modalidad de uso de esta naturaleza requerirá, cuando sea susceptible de autorización, una licencia específica previamente negociada y formalizada por escrito con Vanessa Zúñiga Tinizaray.
Esta restricción no se aplica a los derechos que correspondan independientemente sobre el código original P_2_3_6_02 sujeto a la Apache License, Version 2.0 ni sobre otros componentes de terceros sujetos a sus propias licencias.
9.6. Alteración de avisos de autoría y licencia
La persona usuaria no podrá eliminar, ocultar, sustituir o modificar los avisos de autoría, copyright, licencia, créditos, referencias legales o elementos identificativos incorporados en AMUKI MODULAR. Visual Construction System. Versión 0.10.
Esta prohibición comprende, entre otros, cualquier alteración que pueda:
- a) presentarla como una herramienta propia o de terceros;
b) ocultar su procedencia;
c) permitir su redistribución sin identificación de su autora;
d) inducir a error respecto de su titularidad;
e) o eludir las condiciones establecidas en la presente licencia.
Los avisos correspondientes a componentes de terceros deberán mantenerse conforme a sus respectivas licencias.
9.7. Autoría y representación
La persona usuaria no podrá presentar como propios ni atribuir a terceros:
- a) AMUKI MODULAR. Visual Construction System. Versión 0.10;
- b) sus desarrollos propios;
- c) su arquitectura funcional;
- d) su interfaz;
- e) sus sistemas de organización e interacción;
- f) su documentación;
- g) ni la metodología pedagógica desarrollada por Vanessa Zúñiga Tinizaray.
Asimismo, la persona usuaria no podrá presentarse como representante, desarrolladora oficial, socia, distribuidora, formadora certificada o persona autorizada para representar AMUKI MODULAR. Visual Construction System. Versión 0.10, salvo que exista un acuerdo específico y escrito que establezca expresamente dicha condición.
9.8. Uso docente no autorizado
La persona usuaria no podrá proporcionar su copia de AMUKI MODULAR. Visual Construction System. Versión 0.10 a estudiantes, participantes o terceros para su utilización en procesos de enseñanza, capacitación o formación.
El uso docente de AMUKI MODULAR. Visual Construction System. Versión 0.10 deberá cumplir las condiciones establecidas en la Cláusula Octava de la presente licencia.
Esta restricción no limita el uso independiente del código original P_2_3_6_02, de Hartmut Bohnacker, Benedikt Gross, Julia Laub y Claudius Lazzeroni, cuando dicho uso se realice conforme a la Apache License, Version 2.0.
9.9. Uso de nombre, identidad y materiales promocionales
La persona usuaria no podrá utilizar el nombre AMUKI MODULAR. Visual Construction System. Versión 0.10, el nombre de Vanessa Zúñiga Tinizaray, logotipos, identidad visual, imágenes de la interfaz, materiales gráficos o elementos promocionales de la Herramienta de manera que implique patrocinio, representación, certificación, asociación, respaldo institucional o aval por parte de Vanessa Zúñiga Tinizaray cuando dicha relación no exista.
Esta disposición no impide la identificación legítima de AMUKI MODULAR. Visual Construction System. Versión 0.10 como herramienta utilizada en una obra, investigación, publicación o proyecto, conforme a las obligaciones de atribución establecidas en la presente licencia.
9.10. Obras creadas por la persona usuaria
Las restricciones establecidas en esta cláusula no afectan los derechos reconocidos a la persona usuaria sobre las obras finales legítimamente creadas mediante AMUKI MODULAR. Visual Construction System. Versión 0.10, conforme a la Cláusula Séptima.
La persona usuaria podrá utilizar, publicar y comercializar sus propias obras finales sin que ello constituya redistribución o explotación de la Herramienta.
9.11. Incumplimiento
El incumplimiento de las restricciones establecidas en la presente cláusula podrá dar lugar a la terminación de los permisos concedidos mediante esta licencia, conforme a las condiciones establecidas en la Cláusula Décima, sin perjuicio de los derechos y acciones que correspondan conforme a la legislación aplicable.
Cláusula Décima
10. Duración, terminación y efectos de la licencia
10.1. Duración de la licencia
La presente licencia se concede por tiempo indefinido exclusivamente respecto de AMUKI MODULAR. Visual Construction System. Versión 0.10, siempre que la persona usuaria cumpla con los términos, condiciones, obligaciones y restricciones establecidos en este documento.
El carácter indefinido de la licencia se refiere únicamente al derecho de uso de AMUKI MODULAR. Visual Construction System. Versión 0.10 y no implica derecho a recibir versiones posteriores, nuevas funcionalidades, nuevas generaciones de la Herramienta ni futuras modalidades de licenciamiento.
Las condiciones relativas a actualizaciones, correcciones y versiones posteriores se regulan específicamente en la Cláusula Décima Primera.
10.2. Terminación por incumplimiento
El incumplimiento sustancial de las obligaciones, restricciones o prohibiciones establecidas en la presente licencia podrá dar lugar a la terminación de los derechos de uso concedidos sobre AMUKI MODULAR. Visual Construction System. Versión 0.10, sin perjuicio de las acciones que correspondan conforme a la legislación aplicable.
Se considerarán especialmente relevantes, entre otros, los incumplimientos relacionados con:
- a) redistribución o entrega no autorizada de AMUKI MODULAR. Visual Construction System. Versión 0.10;
- b) cesión, préstamo, sublicenciamiento o utilización de una licencia individual por terceros;
- c) publicación o puesta a disposición no autorizada del código propio, archivos internos o componentes protegidos de la Herramienta;
- d) utilización de los desarrollos propios de Vanessa Zúñiga Tinizaray para crear o distribuir otra herramienta o producto de software en contra de las condiciones de la presente licencia;
- e) exposición no autorizada del código propio, archivos internos, arquitectura interna, documentación protegida u otros componentes protegidos a plataformas de inteligencia artificial, asistentes de programación, servicios automatizados u otros sistemas de terceros, conforme a la Cláusula Novena;
- f) eliminación u ocultamiento intencionado de avisos de autoría, copyright, licencia o identificación;
- g) utilización no autorizada de una licencia individual en modalidades colectivas, institucionales o compartidas;
- h) y cualquier otra conducta que vulnere de manera sustancial los derechos o restricciones establecidos en la presente licencia.
10.3. Efectos de la terminación
Cuando la licencia haya terminado por incumplimiento, la persona usuaria deberá cesar el uso de AMUKI MODULAR. Visual Construction System. Versión 0.10 y eliminar las copias de la Herramienta que se encuentren bajo su posesión o control, incluyendo instalaciones activas y copias de respaldo.
La terminación de la licencia no autoriza a la persona usuaria a conservar una copia funcional para continuar utilizándola.
Podrán conservarse únicamente aquellos documentos o archivos cuya conservación resulte jurídicamente necesaria como evidencia en un procedimiento administrativo, judicial o de resolución de controversias, sin que ello autorice su utilización ordinaria.
10.4. Obras y proyectos creados antes de la terminación
La terminación de la licencia no afecta los derechos legítimamente adquiridos por la persona usuaria sobre las obras finales originales creadas antes de la terminación, siempre que dichas obras hayan sido producidas conforme a las condiciones establecidas en la presente licencia.
La persona usuaria podrá continuar utilizando, exhibiendo, publicando o comercializando dichas obras finales conforme a la Cláusula Séptima y a los derechos que legítimamente posea sobre los contenidos incorporados en ellas.
La terminación de la licencia tampoco transfiere a Vanessa Zúñiga Tinizaray derechos sobre las obras originales creadas por la persona usuaria.
10.5. Subsistencia de determinadas obligaciones
La terminación de la licencia no extingue aquellas obligaciones que, por su naturaleza, deban continuar produciendo efectos después de su terminación.
En particular, continuarán siendo aplicables las disposiciones relativas a:
- a) autoría y propiedad intelectual;
- b) atribución cuando corresponda;
- c) prohibición de redistribución del material obtenido durante la vigencia de la licencia;
- d) protección de materiales pedagógicos;
- e) responsabilidad sobre contenidos de terceros;
- f) limitaciones de responsabilidad;
- g) y demás disposiciones que por su naturaleza deban mantenerse vigentes después de terminado el derecho de uso.
10.6. Derechos derivados de licencias de terceros
La terminación de la presente licencia afecta únicamente los derechos concedidos por Vanessa Zúñiga Tinizaray respecto de AMUKI MODULAR. Visual Construction System. Versión 0.10 y de sus aportes autorales propios.
La terminación no modifica ni extingue los derechos que la persona usuaria pudiera ejercer independientemente sobre el código original P_2_3_6_02 u otros componentes de terceros conforme a la Apache License, Version 2.0 o a las licencias que respectivamente les sean aplicables.
Cláusula Décima Primera
11. Versiones, correcciones, actualizaciones y alcance de la licencia
11.1. Versión comprendida en la licencia
La presente licencia corresponde exclusivamente a AMUKI MODULAR. Visual Construction System. Versión 0.10, entregada a la persona usuaria como parte del Taller “Modularidad con Processing. Nivel I”, mediante adquisición directa de una licencia individual o mediante otra modalidad individual autorizada por Vanessa Zúñiga Tinizaray.
El derecho de uso concedido mediante esta licencia permanece vinculado a AMUKI MODULAR. Visual Construction System. Versión 0.10 y no se extiende automáticamente a versiones posteriores de la Herramienta.
11.2. Desarrollo continuo de la Herramienta
AMUKI MODULAR. Visual Construction System. Versión 0.10 forma parte de un proceso continuo de investigación, diseño y desarrollo llevado a cabo por Vanessa Zúñiga Tinizaray.
En consecuencia, la Herramienta puede ser objeto de ajustes técnicos, correcciones de errores, mejoras de estabilidad, modificaciones internas, refinamientos funcionales y otras intervenciones propias de su proceso de desarrollo.
La existencia de dicho proceso continuo no implica que AMUKI MODULAR. Visual Construction System. Versión 0.10 se encuentre libre de errores, incompatibilidades o comportamientos técnicos no previstos.
11.3. Correcciones correspondientes a la Versión 0.10
Cuando Vanessa Zúñiga Tinizaray identifique un error, incidencia o problema técnico correspondiente a la versión original de AMUKI MODULAR. Visual Construction System. Versión 0.10, podrá desarrollar y poner a disposición de las personas usuarias una corrección o revisión de mantenimiento cuando lo considere técnicamente pertinente y de acuerdo con su disponibilidad.
Las correcciones que Vanessa Zúñiga Tinizaray determine expresamente como pertenecientes a AMUKI MODULAR. Visual Construction System. Versión 0.10 podrán ser entregadas a las personas que dispongan de una licencia válida para dicha versión, sin que ello constituya el otorgamiento de una licencia sobre una versión futura.
11.4. Ausencia de plazos obligatorios de corrección
La presente licencia no establece tiempos determinados de respuesta, diagnóstico, desarrollo, corrección o entrega de soluciones técnicas.
La identificación o comunicación de una incidencia por parte de una persona usuaria no genera obligación de corrección inmediata ni dentro de un plazo específico.
Vanessa Zúñiga Tinizaray determinará, conforme a la naturaleza de la incidencia, las condiciones técnicas de la Herramienta, sus prioridades de desarrollo y su disponibilidad, el momento y la forma en que pueda analizarse o corregirse un problema correspondiente a AMUKI MODULAR. Visual Construction System. Versión 0.10.
11.5. Correcciones y nuevas funcionalidades
Una corrección técnica, ajuste de estabilidad, reparación de un error o revisión interna que Vanessa Zúñiga Tinizaray determine como parte de AMUKI MODULAR. Visual Construction System. Versión 0.10 no genera derecho a recibir nuevas funcionalidades, ampliaciones sustanciales, nuevas herramientas, nuevos sistemas, nuevos niveles formativos ni desarrollos posteriores.
La autora determinará cuándo una modificación constituye mantenimiento de AMUKI MODULAR. Visual Construction System. Versión 0.10 y cuándo corresponde a una nueva versión de la Herramienta.
11.6. Versiones futuras
La licencia de AMUKI MODULAR. Visual Construction System. Versión 0.10 no concede derecho automático a acceder, recibir, descargar, instalar, utilizar o reclamar versiones futuras de la Herramienta.
Esta exclusión comprende cualquier versión posterior que Vanessa Zúñiga Tinizaray identifique como una nueva versión, independientemente de que mantenga continuidad conceptual, visual, técnica o funcional con AMUKI MODULAR. Visual Construction System. Versión 0.10.
11.7. Nuevas versiones y nuevos niveles formativos
El desarrollo continuo de la Herramienta podrá dar lugar a nuevas versiones, ampliaciones, configuraciones, herramientas complementarias o nuevos niveles del Taller “Modularidad con Processing”.
Cada nueva versión o nivel podrá disponer de funcionalidades, condiciones de acceso, alcance de uso, licencia y valor económico propios.
La participación en el Taller “Modularidad con Processing. Nivel I” y la licencia de AMUKI MODULAR. Visual Construction System. Versión 0.10 no generan derecho adquirido sobre dichos desarrollos posteriores.
11.8. Acceso a versiones posteriores
El acceso a versiones posteriores de la Herramienta podrá producirse únicamente mediante las condiciones que Vanessa Zúñiga Tinizaray establezca para cada nueva versión. Estas condiciones podrán incluir, según corresponda:
- a) participación en una nueva edición o nivel del taller;
- b) adquisición de una nueva licencia;
- c) actualización mediante condiciones específicas;
- d) celebración de un acuerdo individual, docente, institucional o de otra naturaleza;
- e) o cualquier otra modalidad de acceso definida por Vanessa Zúñiga Tinizaray.
La existencia de una licencia previa no obliga a Vanessa Zúñiga Tinizaray a ofrecer condiciones preferenciales, actualizaciones gratuitas ni acceso automático a versiones posteriores.
11.9. Modificaciones realizadas por la persona usuaria
Las correcciones y actualizaciones contempladas en esta cláusula se refieren a la versión legítimamente entregada por Vanessa Zúñiga Tinizaray.
Cuando AMUKI MODULAR. Visual Construction System. Versión 0.10 haya sido modificada, alterada o intervenida por la persona usuaria o por terceros, las consecuencias técnicas de dichas modificaciones no se considerarán errores propios de la versión original entregada por la autora.
Las condiciones de responsabilidad y soporte aplicables a copias modificadas se establecen específicamente en la Cláusula Décima Tercera de la presente licencia.
11.10. Independencia entre licencia indefinida y actualizaciones futuras
El carácter indefinido de la licencia establecido en la Cláusula Décima significa que la persona usuaria podrá continuar utilizando legítimamente AMUKI MODULAR. Visual Construction System. Versión 0.10 mientras cumpla las condiciones de la presente licencia.
Dicho carácter indefinido no convierte la licencia en una suscripción de mantenimiento, servicio permanente de soporte ni derecho de acceso a desarrollos futuros.
Cláusula Décima Segunda
12. Naturaleza de la licencia, titularidad y obras resultantes
12.1. Naturaleza de la licencia
AMUKI MODULAR. Visual Construction System. Versión 0.10 no se transfiere a la persona usuaria como propiedad intelectual ni como software cuya titularidad sea adquirida mediante la participación en el taller, el pago de una licencia o cualquier otra modalidad de acceso autorizada.
La persona usuaria recibe exclusivamente un derecho de uso de AMUKI MODULAR. Visual Construction System. Versión 0.10, sujeto a los términos, condiciones, permisos y restricciones establecidos en la presente licencia.
El pago que corresponda por el taller, por la licencia o por cualquier modalidad autorizada de acceso no constituye compraventa de los derechos de propiedad intelectual sobre AMUKI MODULAR. Visual Construction System. Versión 0.10.
12.2. Ausencia de cesión de derechos
La presente licencia no implica cesión, transferencia, venta ni renuncia de los derechos que correspondan a Vanessa Zúñiga Tinizaray sobre sus aportes autorales propios incorporados en AMUKI MODULAR. Visual Construction System. Versión 0.10.
En particular, la persona usuaria no adquiere derechos de titularidad sobre:
- a) el código propio desarrollado por Vanessa Zúñiga Tinizaray;
- b) la arquitectura funcional de la Herramienta;
- c) los sistemas de organización e interacción;
- d) la interfaz;
- e) la documentación;
- f) la metodología pedagógica;
- g) los materiales propios asociados al Taller “Modularidad con Processing. Nivel I”;
- h) ni los demás desarrollos originales protegidos conforme a la presente licencia.
Lo anterior se entiende sin perjuicio de los derechos independientes que correspondan sobre el código original P_2_3_6_02 y sobre otros componentes de terceros sujetos a sus respectivas licencias.
12.3. Titularidad de las obras finales
Las obras finales originales creadas por la persona usuaria mediante AMUKI MODULAR. Visual Construction System. Versión 0.10 pertenecen a dicha persona, siempre que deriven de sus propias decisiones creativas y de contenidos sobre los cuales disponga legítimamente de los derechos necesarios.
En consecuencia, la persona usuaria podrá exhibir, publicar, reproducir, difundir, licenciar y comercializar dichas obras finales conforme a lo establecido en la Cláusula Séptima.
La utilización de AMUKI MODULAR. Visual Construction System. Versión 0.10 como medio de creación no convierte a Vanessa Zúñiga Tinizaray en autora o coautora de las obras originales producidas por la persona usuaria.
12.4. Identificación de la herramienta utilizada
El reconocimiento de los derechos de la persona usuaria sobre sus obras finales no elimina la obligación de identificar AMUKI MODULAR. Visual Construction System. Versión 0.10 cuando, conforme a las Cláusulas Quinta y Séptima, resulte pertinente indicar la herramienta utilizada en un contexto académico, investigativo, expositivo, documental o profesional.
Dicha identificación reconoce exclusivamente la herramienta utilizada en el proceso de creación y no implica participación de Vanessa Zúñiga Tinizaray en la autoría de la obra final.
12.5. Contenidos incorporados por la persona usuaria
Los derechos reconocidos sobre las obras finales no implican que Vanessa Zúñiga Tinizaray garantice la titularidad o legitimidad de imágenes, tipografías, archivos SVG, videos, textos, recursos gráficos, audiovisuales, digitales u otros contenidos incorporados por la persona usuaria a AMUKI MODULAR. Visual Construction System. Versión 0.10.
La persona usuaria será exclusivamente responsable de contar con las licencias, permisos, autorizaciones o derechos necesarios sobre dichos contenidos.
El hecho de que AMUKI MODULAR. Visual Construction System. Versión 0.10 permita técnicamente importar, visualizar, organizar, transformar o utilizar un determinado archivo o recurso no constituye autorización, licencia ni garantía de Vanessa Zúñiga Tinizaray respecto de los derechos aplicables a dicho contenido.
12.6. Independencia entre la Herramienta y los contenidos de la persona usuaria
Los módulos, grupos, sets, composiciones, patrones, proyectos y demás contenidos originales creados por la persona usuaria mediante AMUKI MODULAR. Visual Construction System. Versión 0.10 no pasan a ser propiedad de Vanessa Zúñiga Tinizaray por haber sido desarrollados utilizando la Herramienta.
De manera recíproca, la creación de dichos contenidos no concede a la persona usuaria derechos de propiedad sobre AMUKI MODULAR. Visual Construction System. Versión 0.10 ni sobre los desarrollos propios de Vanessa Zúñiga Tinizaray.
12.7. Independencia respecto de componentes de terceros
Ninguna disposición de la presente cláusula modifica las condiciones aplicables al código original P_2_3_6_02, de Hartmut Bohnacker, Benedikt Gross, Julia Laub y Claudius Lazzeroni, ni a otros componentes de terceros utilizados por AMUKI MODULAR. Visual Construction System. Versión 0.10.
Los derechos correspondientes a dichos componentes continuarán determinados por la Apache License, Version 2.0 o por las licencias que respectivamente resulten aplicables.
Cláusula Décima Tercera
13. Exención de garantías, soporte técnico y limitación de responsabilidad
13.1. Entrega de la Herramienta
AMUKI MODULAR. Visual Construction System. Versión 0.10 se entrega a la persona usuaria en el estado técnico en que se encuentra al momento de su entrega, bajo el principio de “tal como está” (“AS IS”), sin garantía de funcionamiento ininterrumpido, ausencia absoluta de errores, compatibilidad universal, disponibilidad permanente o adecuación a un propósito particular, salvo aquellas garantías o responsabilidades que no puedan excluirse conforme a la legislación aplicable.
La persona usuaria reconoce que, como todo software en proceso continuo de desarrollo, AMUKI MODULAR. Visual Construction System. Versión 0.10 puede presentar errores, comportamientos técnicos no previstos, incompatibilidades o incidencias que requieran revisión o corrección.
13.2. Corrección de incidencias de la versión original
Cuando Vanessa Zúñiga Tinizaray identifique una incidencia técnica correspondiente a la versión original de AMUKI MODULAR. Visual Construction System. Versión 0.10, podrá analizarla, corregirla o publicar una revisión de mantenimiento de acuerdo con su criterio técnico, proceso de desarrollo y disponibilidad.
La comunicación de una incidencia por parte de una persona usuaria no genera obligación de diagnóstico, respuesta, corrección o entrega de una solución dentro de un plazo determinado.
Las condiciones relativas a correcciones y actualizaciones de AMUKI MODULAR. Visual Construction System. Versión 0.10 se encuentran desarrolladas en la Cláusula Décima Primera.
13.3. Naturaleza del soporte técnico
La presente licencia no incluye un servicio de soporte técnico permanente, inmediato, continuo ni sujeto a tiempos específicos de respuesta o resolución.
Vanessa Zúñiga Tinizaray podrá brindar orientación, asistencia o soporte técnico relacionado con AMUKI MODULAR. Visual Construction System. Versión 0.10 cuando lo considere pertinente y de acuerdo con su disponibilidad.
La prestación ocasional de asistencia técnica no genera una obligación de mantener dicho servicio en el futuro ni establece un compromiso permanente de soporte.
13.4. Modificaciones realizadas por la persona usuaria o por terceros
Vanessa Zúñiga Tinizaray no será responsable por errores, fallos de funcionamiento, pérdida de funcionalidades, corrupción de archivos, pérdida de datos, incompatibilidades, alteraciones del comportamiento o cualquier otro problema producido como consecuencia de modificaciones, intervenciones o alteraciones realizadas por la persona usuaria o por terceros sobre AMUKI MODULAR. Visual Construction System. Versión 0.10.
Esta exclusión comprende, entre otros supuestos, modificaciones realizadas:
- a) directamente sobre el código o archivos internos de la Herramienta;
- b) mediante editores, entornos de programación u otras herramientas de desarrollo;
- c) mediante asistentes de programación;
- d) mediante plataformas, modelos o sistemas de inteligencia artificial;
- e) mediante servicios automatizados de generación, análisis, corrección o transformación de código;
- f) mediante reemplazo, eliminación o alteración de archivos, bibliotecas, dependencias o recursos necesarios para el funcionamiento de la Herramienta;
- g) o mediante cualquier otro procedimiento que modifique la versión original entregada por Vanessa Zúñiga Tinizaray.
13.5. Copias modificadas
Cuando una copia de AMUKI MODULAR. Visual Construction System. Versión 0.10 haya sido modificada, intervenida o alterada respecto de la versión original entregada por Vanessa Zúñiga Tinizaray, la autora no garantiza su estabilidad, funcionamiento, compatibilidad, integridad ni posibilidad de recuperación.
Las incidencias producidas como consecuencia de dichas modificaciones no se considerarán errores propios de la versión original de AMUKI MODULAR. Visual Construction System. Versión 0.10.
Vanessa Zúñiga Tinizaray no estará obligada a reparar, restaurar, depurar, reconstruir ni proporcionar soporte técnico sobre copias modificadas por la persona usuaria o por terceros.
Cualquier asistencia que eventualmente pudiera brindar respecto de una copia modificada quedará exclusivamente sujeta a su criterio, disponibilidad y condiciones que determine para cada caso.
13.6. Entorno técnico y compatibilidad
El funcionamiento de AMUKI MODULAR. Visual Construction System. Versión 0.10 puede depender de factores externos a Vanessa Zúñiga Tinizaray, incluyendo, entre otros:
- a) sistema operativo;
- b) versión de Processing;
- c) Java;
- d) controladores gráficos;
- e) hardware;
- f) bibliotecas y dependencias de terceros;
- g) formatos de archivo;
- h) configuraciones del sistema;
- i) cambios introducidos por fabricantes o desarrolladores de software externo;
- j) y actualizaciones posteriores del entorno informático de la persona usuaria.
En consecuencia, Vanessa Zúñiga Tinizaray no garantiza que AMUKI MODULAR. Visual Construction System. Versión 0.10 permanezca indefinidamente compatible con modificaciones futuras realizadas por terceros en sistemas operativos, hardware, Processing, Java, bibliotecas, controladores u otras dependencias externas.
13.7. Responsabilidad sobre archivos, proyectos y copias de respaldo
La persona usuaria será responsable de conservar copias de respaldo adecuadas de sus proyectos, archivos originales, recursos importados y resultados generados mediante AMUKI MODULAR. Visual Construction System. Versión 0.10.
Vanessa Zúñiga Tinizaray no será responsable, en la máxima medida permitida por la legislación aplicable, por pérdida, corrupción, eliminación o imposibilidad de recuperación de proyectos, archivos o contenidos cuando dichos efectos deriven de fallos del entorno informático, errores de operación, modificaciones realizadas por la persona usuaria, daños del hardware, software de terceros, ausencia de copias de respaldo u otras circunstancias que se encuentren fuera de su control razonable.
13.8. Contenidos incorporados por la persona usuaria
Vanessa Zúñiga Tinizaray no verifica ni garantiza la titularidad, licitud, procedencia, licencia o autorización correspondiente a imágenes, tipografías, archivos SVG, videos, textos, recursos gráficos, audiovisuales, digitales u otros contenidos que la persona usuaria incorpore a AMUKI MODULAR. Visual Construction System. Versión 0.10.
La persona usuaria será exclusivamente responsable de determinar si dispone de los derechos necesarios para utilizar, transformar, publicar, distribuir o comercializar dichos contenidos.
Vanessa Zúñiga Tinizaray no será responsable por reclamaciones, infracciones o conflictos derivados de la utilización no autorizada de contenidos pertenecientes a terceros incorporados por la persona usuaria.
13.9. Resultados obtenidos mediante la Herramienta
AMUKI MODULAR. Visual Construction System. Versión 0.10 constituye una herramienta de construcción visual y no garantiza la obtención de resultados creativos, académicos, profesionales, comerciales o técnicos específicos.
La valoración, idoneidad, originalidad, pertinencia, calidad y utilización de los resultados generados mediante la Herramienta corresponden exclusivamente a la persona usuaria.
13.10. Limitación general de responsabilidad
En la máxima medida permitida por la legislación vigente, Vanessa Zúñiga Tinizaray no será responsable por daños, pérdidas, interrupciones de actividad, pérdida de información, pérdida de oportunidades, incompatibilidades, resultados no esperados u otras consecuencias derivadas del uso, uso indebido o imposibilidad de uso de AMUKI MODULAR. Visual Construction System. Versión 0.10, cuando dichas consecuencias no sean jurídicamente imputables a la autora conforme a la legislación aplicable.
Ninguna disposición de la presente cláusula deberá interpretarse como exclusión o limitación de responsabilidades que, conforme a la legislación vigente de la República del Ecuador, no puedan ser legalmente excluidas o limitadas.
13.11. Responsabilidades de la persona usuaria
Corresponde a la persona usuaria:
- a) utilizar AMUKI MODULAR. Visual Construction System. Versión 0.10 conforme a la presente licencia;
- b) conservar copias de respaldo periódicas de sus proyectos y archivos;
- c) mantener los archivos originales de los recursos incorporados;
- d) verificar las licencias y derechos correspondientes a contenidos de terceros;
- e) verificar la compatibilidad de su equipo y entorno técnico;
- f) evitar modificaciones no autorizadas de la Herramienta;
- g) asumir las consecuencias derivadas de intervenciones realizadas por ella misma o por terceros sobre su copia;
- h) y evaluar la idoneidad de AMUKI MODULAR. Visual Construction System. Versión 0.10 para el proyecto o finalidad específica en que decida utilizarla.
13.12. Privacidad y ausencia de recopilación de datos por la Herramienta
AMUKI MODULAR. Visual Construction System. Versión 0.10 no está diseñada para recopilar, transmitir ni proporcionar a Vanessa Zúñiga Tinizaray datos personales, telemetría, analíticas de uso ni contenidos de los proyectos desarrollados por la persona usuaria.
Vanessa Zúñiga Tinizaray no accede mediante la Herramienta a los proyectos, archivos, imágenes, tipografías, recursos o demás contenidos incorporados o generados por la persona usuaria.
Esta disposición se refiere exclusivamente al funcionamiento de AMUKI MODULAR. Visual Construction System. Versión 0.10 y no comprende servicios, plataformas, sistemas operativos o herramientas de terceros que la persona usuaria decida utilizar independientemente.
Cláusula Décima Cuarta
14. Información legal, vigencia e identificación de la licencia
14.1. Licencia aplicable
El presente documento constituye la licencia completa aplicable a AMUKI MODULAR. Visual Construction System. Versión 0.10 y forma parte de la documentación asociada a su entrega.
Las condiciones contenidas en esta licencia regulan exclusivamente la versión expresamente identificada como AMUKI MODULAR. Visual Construction System. Versión 0.10, sin extenderse automáticamente a versiones posteriores de la Herramienta.
14.2. Inicio de vigencia
La presente licencia entra en vigor respecto de cada persona usuaria desde el momento en que esta instala, ejecuta, accede o utiliza AMUKI MODULAR. Visual Construction System. Versión 0.10.
El uso de la Herramienta implica la aceptación de los términos y condiciones establecidos en la presente licencia, conforme a lo señalado en la Sección Preliminar.
14.3. Identificación de la licencia concedida
La copia de la licencia entregada junto con AMUKI MODULAR. Visual Construction System. Versión 0.10 acredita la versión de la Herramienta y las condiciones bajo las cuales fue concedido inicialmente el derecho de uso a la persona usuaria.
Asimismo, dicha copia podrá conservarse como constancia documental de la licencia recibida.
Sin embargo, para efectos de consulta, corrección de errores materiales o tipográficos, problemas de numeración, actualización de referencias y demás ajustes que no alteren el sentido, alcance, derechos u obligaciones de la licencia concedida, la versión oficial y vigente del texto de la licencia será la publicada en el sitio web oficial de Vanessa Zúñiga Tinizaray, conforme a lo establecido en el numeral 14.5.
La publicación de una versión actualizada de la licencia no implica, por sí sola, la concesión de derechos sobre versiones posteriores de la Herramienta ni modifica el alcance de la versión de la Herramienta originalmente licenciada.
14.4. Copias de la licencia
La licencia podrá ser proporcionada en formato digital, PDF, documento electrónico, sitio web u otro soporte utilizado por Vanessa Zúñiga Tinizaray para acompañar la entrega de AMUKI MODULAR. Visual Construction System. Versión 0.10.
La reproducción de la licencia con fines de consulta, archivo o acreditación de las condiciones de uso no modifica su contenido ni concede derechos adicionales sobre la Herramienta.
14.5. Versión oficial del documento
La versión oficial, vigente y actualizada de la licencia correspondiente a AMUKI MODULAR. Visual Construction System. Versión 0.10 será la publicada en el sitio web oficial de Vanessa Zúñiga Tinizaray:
Las copias de la licencia entregadas en formato PDF, impreso, digital, adjunto u otro soporte tendrán carácter documental y de consulta.
En caso de existir errores materiales, errores tipográficos, problemas de numeración, referencias desactualizadas u otras diferencias entre distintas copias de la licencia que no alteren el sentido, alcance, derechos u obligaciones correspondientes a la licencia concedida, prevalecerá como referencia oficial el texto vigente publicado en el sitio web oficial.
La persona usuaria podrá consultar en dicho sitio la versión oficial y actualizada de las condiciones aplicables a AMUKI MODULAR. Visual Construction System. Versión 0.10.
La prevalencia del texto publicado en el sitio web oficial respecto de otras copias se entenderá dentro de los límites establecidos en el numeral 14.6 y no implicará, por sí misma, modificación retroactiva de derechos u obligaciones previamente concedidos.
14.6. Correcciones y actualizaciones de la licencia
Vanessa Zúñiga Tinizaray podrá corregir o actualizar la presente licencia cuando resulte necesario para subsanar errores materiales o tipográficos, corregir problemas de numeración, actualizar referencias legales o técnicas o realizar otros ajustes que no alteren el sentido, alcance, derechos u obligaciones correspondientes a una licencia ya concedida.
Estas correcciones y actualizaciones serán incorporadas a la versión oficial publicada en el sitio web señalado en el numeral 14.5.
Cualquier modificación que altere el sentido o alcance de los derechos u obligaciones correspondientes a una licencia ya concedida no será aplicable retroactivamente a la persona usuaria, salvo que esta la acepte expresamente o que una disposición legal de obligatorio cumplimiento establezca lo contrario.
Las versiones futuras de la Herramienta que Vanessa Zúñiga Tinizaray identifique como versiones distintas podrán estar sujetas a nuevas condiciones de licencia, conforme a la Cláusula Décima Primera.
14.7. Independencia respecto de versiones futuras
La publicación de una nueva licencia, una nueva modalidad contractual o una versión posterior de la Herramienta no genera derecho de actualización, sustitución, migración o acceso automático para las personas que dispongan de una licencia de AMUKI MODULAR. Visual Construction System. Versión 0.10.
Los derechos respecto de versiones posteriores se regirán por lo establecido en la Cláusula Décima Primera.
14.8. Integridad de la licencia
La presente licencia deberá interpretarse conjuntamente con todas sus cláusulas, definiciones, permisos, restricciones y disposiciones complementarias.
Ninguna cláusula deberá interpretarse aisladamente de forma que amplíe derechos expresamente limitados en otras disposiciones de la presente licencia.
Cláusula Décima Quinta
15. Legislación aplicable y jurisdicción
15.1. Legislación aplicable
La presente licencia de AMUKI MODULAR. Visual Construction System. Versión 0.10 se regirá e interpretará de conformidad con la legislación vigente de la República del Ecuador.
15.2. Normativa sobre derechos intelectuales
En particular, resultará aplicable el Código Orgánico de la Economía Social de los Conocimientos, Creatividad e Innovación, publicado originalmente en el Suplemento al Registro Oficial No. 899, de 9 de diciembre de 2016, incluidas sus reformas vigentes, así como las demás normas ecuatorianas que resulten aplicables en materia de derechos de autor, software, propiedad intelectual, contratos y protección de derechos.
La referencia al Código comprenderá las reformas, modificaciones, sustituciones o disposiciones legalmente vigentes que resulten aplicables durante la ejecución e interpretación de la presente licencia.
15.3. Consulta oficial del texto legal
Para efectos de consulta y verificación de la normativa aplicable, el Código Orgánico de la Economía Social de los Conocimientos, Creatividad e Innovación podrá consultarse en las siguientes fuentes oficiales del Estado ecuatoriano:
Asamblea Nacional del Ecuador:
Ministerio de Educación, Deporte y Cultura del Ecuador:
Para determinar la normativa vigente aplicable en cada momento deberán considerarse igualmente las reformas posteriores que hayan sido publicadas oficialmente.
En caso de que alguna de estas direcciones electrónicas sea modificada, sustituida o deje de estar disponible, deberá acudirse a las fuentes oficiales vigentes del Estado ecuatoriano para consultar la normativa aplicable.
15.4. Componentes sometidos a licencias de terceros
La aplicación de la legislación ecuatoriana a la presente licencia no modifica las condiciones correspondientes al código original P_2_3_6_02, sujeto a la Apache License, Version 2.0, ni las licencias aplicables a otros componentes de terceros utilizados por AMUKI MODULAR. Visual Construction System. Versión 0.10.
Los derechos y obligaciones derivados de dichos componentes continuarán rigiéndose por sus respectivas licencias, sin perjuicio de las normas de obligatorio cumplimiento que resulten aplicables.
15.5. Jurisdicción
Las controversias relacionadas con la interpretación, cumplimiento, incumplimiento, terminación o aplicación de la presente licencia que no puedan resolverse directamente entre las partes se someterán a los jueces y tribunales competentes de la República del Ecuador, conforme a las normas ecuatorianas de competencia y procedimiento aplicables.
15.6. Normas de obligatorio cumplimiento
Ninguna disposición de la presente licencia deberá interpretarse de manera que excluya, limite o sustituya derechos, obligaciones, garantías, competencias judiciales o responsabilidades que, conforme a la legislación vigente de la República del Ecuador, sean de aplicación obligatoria y no puedan ser modificadas mediante acuerdo entre las partes.
Cuando alguna disposición de la presente licencia entre en conflicto con una norma de obligatorio cumplimiento, se aplicará dicha norma únicamente en la medida necesaria, sin afectar la validez de las demás disposiciones de la licencia.
15.7. Cambios normativos posteriores
Las modificaciones posteriores de la legislación ecuatoriana que resulten obligatoriamente aplicables a AMUKI MODULAR. Visual Construction System. Versión 0.10 o a la presente licencia se entenderán incorporadas en la medida exigida por la normativa vigente.
La incorporación de dichos cambios normativos no implicará, por sí misma, la concesión de nuevos derechos de uso, nuevas funcionalidades, actualizaciones, versiones posteriores ni otras modalidades de licencia sobre AMUKI MODULAR. Visual Construction System. Versión 0.10.
Cláusula Décima Sexta
16. Idioma y versión prevalente
16.1. Idioma original
La presente licencia de AMUKI MODULAR. Visual Construction System. Versión 0.10 ha sido redactada originalmente en idioma español.
El texto en español constituye la versión original de la presente licencia.
16.2. Traducciones
La licencia podrá ser traducida total o parcialmente a otros idiomas con fines informativos, académicos, administrativos o para facilitar su comprensión por parte de personas usuarias que no tengan el español como lengua principal.
Salvo que Vanessa Zúñiga Tinizaray establezca expresamente por escrito lo contrario, dichas traducciones no constituirán versiones jurídicas independientes de la licencia.
16.3. Prevalencia de la versión en español
En caso de discrepancia, contradicción, diferencia de interpretación, error de traducción o divergencia entre la versión original en español y cualquier traducción de la presente licencia, prevalecerá la versión oficial en español.
La interpretación de las condiciones aplicables a AMUKI MODULAR. Visual Construction System. Versión 0.10 deberá realizarse tomando como referencia el texto oficial en español.
16.4. Versión oficial publicada
La versión oficial en español de la licencia será la publicada en el sitio web oficial de Vanessa Zúñiga Tinizaray, conforme a lo establecido en la Cláusula Décima Cuarta:
Las traducciones publicadas o suministradas junto con AMUKI MODULAR. Visual Construction System. Versión 0.10 deberán interpretarse conjuntamente con dicha versión oficial en español.
Cláusula Décima Séptima
17. Nulidad parcial y conservación de la licencia
17.1. Nulidad o inaplicabilidad de una disposición
Si alguna disposición de la presente licencia de AMUKI MODULAR. Visual Construction System. Versión 0.10 fuese declarada total o parcialmente nula, inválida, ilegal o inaplicable por una autoridad competente, dicha circunstancia no afectará, por sí sola, la validez, legalidad ni exigibilidad de las demás disposiciones de la licencia.
17.2. Conservación de las disposiciones restantes
Las cláusulas, numerales y disposiciones que no resulten afectados por dicha nulidad, invalidez o inaplicabilidad conservarán plena vigencia y continuarán produciendo sus efectos en la máxima medida permitida por la legislación aplicable.
17.3. Interpretación y ajuste de la disposición afectada
Cuando resulte jurídicamente posible, la disposición afectada deberá interpretarse o ajustarse únicamente en la medida necesaria para que resulte válida y aplicable, procurando conservar, en la máxima medida permitida por la legislación vigente, la finalidad original de la disposición y el equilibrio general de la presente licencia.
17.4. Ausencia de ampliación automática de derechos
La nulidad, invalidez o inaplicabilidad de una disposición no deberá interpretarse como concesión automática de derechos adicionales a la persona usuaria sobre AMUKI MODULAR. Visual Construction System. Versión 0.10, ni como renuncia de Vanessa Zúñiga Tinizaray a los derechos que continúen siendo válidamente reconocidos por la presente licencia o por la legislación aplicable.
Cláusula Décima Octava
18. No renuncia de derechos
18.1. Falta de ejercicio de un derecho
La falta de ejercicio, demora, tolerancia o decisión de Vanessa Zúñiga Tinizaray de no exigir inmediatamente el cumplimiento de cualquiera de las disposiciones de la presente licencia no constituirá renuncia a los derechos que le correspondan respecto de AMUKI MODULAR. Visual Construction System. Versión 0.10.
18.2. Ausencia de modificación por tolerancia
El hecho de que Vanessa Zúñiga Tinizaray permita, tolere o no objete una determinada conducta en una ocasión concreta no modificará automáticamente las condiciones de la presente licencia ni podrá interpretarse como autorización general, permanente o extensible a situaciones futuras.
18.3. Renuncia expresa

Definitions and Acceptance
For the purposes of this license, the following terms shall have the meanings set forth below:
- Tool: AMUKI MODULAR. Visual Construction System. Versión 0.10, including its proprietary code, technical architecture, functional structure, interface, internal logic, interaction systems, proprietary documentation, and complementary files that specifically form part of this version.
Materials or third-party components delivered independently do not form part of the Tool, including the original P_2_3_6_02.pde file and the copy of the Apache License, Version 2.0, whose authorship and licensing regime are governed separately in Clause One.
- User: the natural person who individually receives and uses AMUKI MODULAR. Visual Construction System. Versión 0.10 under a valid license granted by Vanessa Zúñiga Tinizaray, either as a participant in the Workshop “Modularidad con Processing. Nivel I” or through the direct acquisition of an individual license by another method authorized by the Author.
- Content incorporated by the User: any module, image, SVG file, typeface, text, graphic, audiovisual or digital resource, or any other content that the User imports, uploads, incorporates, or uses through AMUKI MODULAR. Visual Construction System. Versión 0.10 shall be the sole responsibility of that User.
The User shall be responsible for holding the copyrights, licenses, permissions, authorizations, or other rights necessary to use the content incorporated into AMUKI MODULAR. Visual Construction System. Versión 0.10.
Vanessa Zúñiga Tinizaray does not verify, control, or guarantee the ownership, provenance, lawfulness, or licensing conditions of content incorporated by Users and assumes no liability for infringements of copyright, related rights, licenses, trademarks, image rights, or other third-party rights arising from the unauthorized use of such content.
The technical ability to import, upload, display, organize, modify, or use content through AMUKI MODULAR. Visual Construction System. Versión 0.10 does not imply that Vanessa Zúñiga Tinizaray grants, recognizes, or guarantees any right over such content.
- Final Works: graphic, typographic, visual, or compositional results generated by the User through AMUKI MODULAR. Visual Construction System. Versión 0.10, based on the User’s own creative decisions and on content for which the User lawfully holds the necessary rights.
- Unpublished / limited-distribution software: software that has not been made available to the general public or distributed openly, massively, or indiscriminately by the Author, and whose delivery takes place exclusively through limited and controlled disclosure to identified persons, within the framework of a workshop, academic agreement, individual license, or specific license previously negotiated and formalized in writing.
The delivery of AMUKI MODULAR. Visual Construction System. Versión 0.10 under these conditions does not authorize the User to reproduce, redistribute, share, publish, make it available to third parties, or facilitate access to it through copies, links, repositories, platforms, digital services, or other means. Any form of use that exceeds the scope of this individual license shall, where such use is eligible for authorization, be subject to a different license previously negotiated and formalized in writing with Vanessa Zúñiga Tinizaray.
The installation, execution, access, use, or exploitation of AMUKI MODULAR. Visual Construction System. Versión 0.10 constitutes the User’s express, full, and unconditional acceptance of this license. If the User does not agree with any of its terms and conditions, the User must refrain from using AMUKI MODULAR. Visual Construction System. Versión 0.10.
Clause One
1. Origin, antecedents, and third-party components.
1.1. Initial conceptual and technical antecedent
AMUKI MODULAR. Visual Construction System. Versión 0.10 recognizes as its initial conceptual and technical antecedent the P_2_3_6_02 sketch (file P_2_3_6_02.pde), published within the framework of the Generative Gestaltung. Creative Coding project, authored by Hartmut Bohnacker, Benedikt Gross, Julia Laub, and Claudius Lazzeroni.
The sketch constituted an initial reference for the exploration of visual systems constructed through adjacency relationships between modules. The current implementation of AMUKI MODULAR. Visual Construction System. Versión 0.10 was subsequently developed with an architecture, functional structure, data model, interface, interaction systems, and functionalities that are substantially differentiated from that sketch.
1.2. Original reference code
The original code corresponding to the P_2_3_6_02 sketch may be consulted publicly at:

In addition, within the framework of the Workshop “Modularidad con Processing. Nivel I”, participants receive, as independent reference material, a folder named P_2_3_6_02 containing the original P_2_3_6_02.pde file.
That file is delivered separately from AMUKI MODULAR. Visual Construction System. Versión 0.10 for the purpose of enabling consultation, study, and independent use of the original code in accordance with its own license.
1.3. License of the original code
In accordance with the copyright and license notices contained in the original P_2_3_6_02.pde file, that code is subject to the Apache License, Version 2.0.

1.7. Organization and architecture developed by the Author
The manner in which AMUKI MODULAR. Visual Construction System. Versión 0.10 organizes, manages, and relates modules, groups, sets, slots, simple and composite structures, linking systems, resources, patterns, colors, and other functional structures, as well as the interaction and operating rules through which these elements participate in visual construction, corresponds to developments subsequently carried out by Vanessa Zúñiga Tinizaray.
These structures and relationships shall not be interpreted as a reproduction of the functional organization of the original sketch, without prejudice to the rights corresponding to the code subject to the Apache License, Version 2.0.
1.8. Subsequent original contributions
The functional developments, extensions, modifications, interaction systems, organizational structures, interface, and documentation incorporated by Vanessa Zúñiga Tinizaray into AMUKI MODULAR. Visual Construction System. Versión 0.10, as well as the proprietary pedagogical methodology associated with the Workshop “Modularidad con Processing. Nivel I”, are subject to the conditions established in this license to the extent that they constitute the Author’s own authorial contributions and without affecting the rights and obligations corresponding to third-party components.
1.9. Third-party components

2. Grant and beneficiaries of the license
2.1. License beneficiary
This license is granted exclusively to the natural person who individually receives AMUKI MODULAR. Visual Construction System. Versión 0.10 under a valid license granted by Vanessa Zúñiga Tinizaray.
The individual license may be obtained as part of participation in the Workshop “Modularidad con Processing. Nivel I” or through direct acquisition of the individual license by another method expressly authorized by Vanessa Zúñiga Tinizaray.
The method through which the license is obtained does not alter its individual nature or expand the rights of use established in this document.
2.2. Individual nature of the license
The license is strictly individual and is granted only to the User to whom AMUKI MODULAR. Visual Construction System. Versión 0.10 is delivered.
Participation in the workshop, the acquisition or payment of a license, or receipt of the Tool by one person does not create rights of use in favor of any other person.
2.3. No extension to third parties
This license does not automatically extend to third parties, including, by way of example and without limitation:
- the User’s students;
- colleagues or collaborators;
- work teams;
- research groups;
- educational institutions;
- universities;
- companies;
- organizations;
- collectives;
- educational platforms;
- laboratories;
- public or private entities.
The existence of an academic, professional, employment, institutional, or contractual relationship between the User and any of these third parties does not grant them any right to install, access, use, copy, or receive AMUKI MODULAR. Visual Construction System. Versión 0.10.
2.4. Scope of the grant
The license authorizes the User to use AMUKI MODULAR. Visual Construction System. Versión 0.10 within the uses expressly authorized in this document.
Any use not expressly authorized shall be understood to be subject to the restrictions and conditions established in the corresponding clauses of this license.
2.5. No institutional relationship or representation
The granting of this license does not create any relationship of association, representation, partnership, franchise, sponsorship, certification, institutional affiliation, or employment between Vanessa Zúñiga Tinizaray and the User.
Likewise, merely receiving this license does not authorize the User to represent Vanessa Zúñiga Tinizaray, act on her behalf, present themselves as a representative of AMUKI MODULAR. Visual Construction System. Versión 0.10, or attribute to the Author any endorsement, approval, or participation in activities carried out by the User.
Clause Three
3. Nature and scope of the license
3.1. Nature of the license
This license is granted to the User on an individual, personal, non-exclusive, non-transferable, and non-sublicensable basis, exclusively for the use of AMUKI MODULAR. Visual Construction System. Versión 0.10 in accordance with the terms and conditions established in this document.
The grant of this license constitutes solely an authorization to use and does not imply a sale, assignment, transfer of intellectual property, or transfer of economic rights in AMUKI MODULAR. Visual Construction System. Versión 0.10.
3.2. Authorized devices
The User may install and use AMUKI MODULAR. Visual Construction System. Versión 0.10 on a maximum of two (2) personal-use devices under the User’s control, for example, a desktop computer and a laptop computer.
The User may also retain one (1) backup copy exclusively for security, recovery, or reinstallation purposes.
The backup copy does not constitute an additional license and may not be used by another person.
3.3. Exclusively personal use
Access to and use of AMUKI MODULAR. Visual Construction System. Versión 0.10 are reserved exclusively for the User who holds the license.
Accordingly, the User may not share, lend, assign, transfer, rent, lease, deliver, provide access to, or permit the use of AMUKI MODULAR. Visual Construction System. Versión 0.10 by third parties, regardless of whether such access is free or paid, temporary or permanent.
3.4. Prohibition of shared or collective use
The individual license does not authorize the installation or use of AMUKI MODULAR. Visual Construction System. Versión 0.10 under a single license on devices intended for shared use by multiple persons, in classrooms, laboratories, institutions, organizations, companies, collectives, educational platforms, servers, or other collective-access environments.
The use of AMUKI MODULAR. Visual Construction System. Versión 0.10 in teaching or institutional contexts must comply with the conditions established in Clause Eight of this license.
3.5. Rights not granted
This license does not grant the User rights to reproduce for distribution, redistribute, publish, communicate to the public, commercialize, sublicense, make available to third parties, or collectively exploit AMUKI MODULAR. Visual Construction System. Versión 0.10, in whole or in part, except under a different license previously negotiated and formalized in writing with Vanessa Zúñiga Tinizaray.
This limitation applies exclusively to AMUKI MODULAR. Visual Construction System. Versión 0.10 and to the elements over which Vanessa Zúñiga Tinizaray is authorized to establish conditions of use, without affecting any rights that independently apply to third-party components subject to their respective licenses.
3.6. No implied license
No provision of this license shall be interpreted as an implied grant of rights other than those expressly established herein.
The acquisition, receipt, installation, or use of AMUKI MODULAR. Visual Construction System. Versión 0.10 does not confer ownership rights over the Tool, its architecture, interface, documentation, pedagogical methodology, or any other authorial contributions of Vanessa Zúñiga Tinizaray.
Clause Four
4. Authorship, proprietary developments, and differentiation from the original antecedent
4.1. Differentiation from the original code
AMUKI MODULAR. Visual Construction System. Versión 0.10 does not constitute a literal reproduction of the P_2_3_6_02 sketch, nor does it retain as its own functional structure the architecture, interface, organization, or limited scope of the original code.
The P_2_3_6_02 sketch constitutes the conceptual and technical antecedent recognized in Clause One. From that antecedent, Vanessa Zúñiga Tinizaray progressively developed a visual construction architecture with its own structures, relationships, interaction systems, organizational mechanisms, and functionalities.
4.2. Development of a proprietary architecture
The current architecture of AMUKI MODULAR. Visual Construction System. Versión 0.10 results from an ongoing process of research, design, experimentation, and development carried out by Vanessa Zúñiga Tinizaray.
In particular, the manner in which the different elements of the Tool are organized, related, linked, managed, and used within the visual construction process corresponds to design and development decisions progressively incorporated by the Author.
4.3. The Author’s own contributions
Without prejudice to the rights corresponding to the original code and other third-party components, the following form part of Vanessa Zúñiga Tinizaray’s own developments associated with AMUKI MODULAR. Visual Construction System. Versión 0.10 and, where applicable, its pedagogical context of use:
- a) the general architecture of the visual construction system;
- b) the functional organization, structuring, and relationships among modules, groups, sets, slots, and the other structures that make up the Tool;
- c) the organization and operation of simple, composite, linked, and other configurations available in this version;
- d) the rules, mechanisms, and systems through which the different elements of the Tool are selected, related, linked, transformed, organized, and used during the visual construction process;
- e) the interaction modes and systems implemented in this version;
- f) the organization and operation of Grid systems and their relationships with the visual construction elements;
- g) the mechanisms for organizing, using, and managing resources incorporated into the Tool;
- h) the systems for managing patterns, color, and other visual properties;
- i) the interaction structure and operation of the graphical user interface;
- j) the mechanisms for selection, transformation, manipulation, and visual composition;
- k) the systems for managing layers and the content that forms part of a composition;
- l) the persistence, saving, loading, and project-recovery mechanisms available in this version;
- m) the import and export functionalities implemented in this version;

This enumeration is descriptive and non-exhaustive and shall be interpreted exclusively with respect to elements actually developed by Vanessa Zúñiga Tinizaray, without affecting rights corresponding to code, libraries, dependencies, general concepts, formats, resources, or components belonging to third parties.
4.4. Rights in the Author’s own contributions
The rights that apply to the proprietary code, functional architecture, system organization, interface, documentation, proprietary materials, and other original developments identified in this clause belong to Vanessa Zúñiga Tinizaray, in accordance with applicable law and without prejudice to third-party rights.
Delivery of AMUKI MODULAR. Visual Construction System. Versión 0.10 to the User does not imply assignment, transfer, or waiver of those rights.
4.5. Elements not claimed as exclusive authorship
This license does not seek to attribute to Vanessa Zúñiga Tinizaray exclusive rights over abstract ideas, general principles of modularity, mathematical concepts, basic geometric shapes, general design methods, programming languages, file formats, libraries, dependencies, code belonging to third parties, or other elements that, by their nature or legal regime, are not capable of exclusive appropriation by the Author.
The protection established in this license applies to the concrete and original developments incorporated by Vanessa Zúñiga Tinizaray into AMUKI MODULAR. Visual Construction System. Versión 0.10.
4.6. Autonomy of content created by the User
The use of the functional structures of AMUKI MODULAR. Visual Construction System. Versión 0.10 does not make Vanessa Zúñiga Tinizaray an author or co-author of modules, groups, sets, compositions, patterns, or original works subsequently created by the User.
Rights in such creations shall be determined in accordance with their respective authorship and the provisions of the subsequent clauses of this license.
4.7. Independence from third-party components
Ownership of the proprietary developments identified in this clause does not affect or modify the rights corresponding to authors, rightsholders, or licensors of code, libraries, dependencies, resources, or other third-party components used by AMUKI MODULAR. Likewise, the lawful use of such third-party components does not imply assignment of rights in the proprietary developments created by Vanessa Zúñiga Tinizaray.

5. Academic use, research, and publications
5.1. Authorized academic use
The User is expressly authorized to use AMUKI MODULAR. Visual Construction System. Versión 0.10 in individual processes of academic production, research, experimentation, and creation, including:
- a) scientific, academic, and pedagogical articles;
- b) undergraduate and postgraduate theses;
- c) degree-completion projects;
- d) presentations, conferences, and academic communications;
- e) research projects;
- f) methodological, didactic, visual, or experimental research;
- g) academic documentation of creative processes;
- h) and other equivalent intellectual productions.
5.2. Academic attribution requirement
Any publication, research project, thesis, academic communication, or intellectual production that uses AMUKI MODULAR. Visual Construction System. Versión 0.10 as a substantial part of its methodology, experimental process, production, or visual construction must expressly acknowledge the Tool used.
The attribution must identify, at a minimum, Vanessa Zúñiga Tinizaray as the author of AMUKI MODULAR. Visual Construction System. Versión 0.10, the full name of the Tool, and the version used.
5.3. Academic references
For the academic attribution of AMUKI MODULAR. Visual Construction System. Versión 0.10, the reference corresponding to the Tool indicated in item 2 of this section must be used.

Under no circumstances does this permission imply:
- a) authorization to reproduce or redistribute AMUKI MODULAR. Visual Construction System. Versión 0.10;
- b) authorization to share copies, installation files, code, or access mechanisms with other persons;
- c) authorization to make AMUKI MODULAR. Visual Construction System. Versión 0.10 available to students, institutions, research teams, or third parties;
- d) authorization to incorporate AMUKI MODULAR. Visual Construction System. Versión 0.10 into repositories, educational platforms, servers, or other distribution systems;

Versión 0.10, each of them must hold their own valid individual license or be covered by a specific licensing arrangement previously negotiated and formalized in writing with Vanessa Zúñiga Tinizaray.
5.7. Teaching use
The use of AMUKI MODULAR. Visual Construction System. Versión 0.10 in teaching, instruction, training, or educational processes directed at third parties shall be governed specifically by Clause Eight of this license.
Clause Six
6. Workshop materials, pedagogical content, and examples
6.1. Materials associated with the workshop
The presentation, exercises, instructions, didactic sequences, support files, explanatory diagrams, documents, and other materials provided or used during the Workshop “Modularidad con Processing. Nivel I” may include both content developed by Vanessa Zúñiga Tinizaray and third-party materials lawfully used for reference, explanation, analysis, or contextualization.
The inclusion of third-party materials in the presentation does not attribute authorship of such materials to Vanessa Zúñiga Tinizaray. Those materials retain the authorship, provenance, and conditions of use applicable to their respective rightsholders.
6.2. Protection of pedagogical materials
The materials developed by Vanessa Zúñiga Tinizaray for the Workshop “Modularidad con Processing. Nivel I” remain subject to copyright and any other rights applicable under the relevant law.
Delivery of or access to those materials permits only their consultation and personal use by the User in support of the User’s learning, experimentation, and individual practice associated with the Workshop “Modularidad con Processing. Nivel I”.
Their delivery does not imply assignment, transfer, or general authorization for their reproduction, adaptation, redistribution, publication, or use in educational processes directed at third parties.
6.3. Examples used in the presentation
In the initial part of the Workshop “Modularidad con Processing. Nivel I”, the presentation incorporates examples from the Generative Gestaltung. Creative Coding project by Hartmut Bohnacker, Benedikt Gross, Julia Laub, and Claudius Lazzeroni, used to explain and contextualize the operation of the original reference sketch P_2_3_6_02 and the principles of modular organization associated with that antecedent.
Authorship of these examples belongs to their respective authors, and their use within the workshop does not imply that Vanessa Zúñiga Tinizaray claims copyright in them.
Subsequently, the presentation incorporates three (3) proprietary examples from the Crónicas Visuales del Abya Yala research project, developed by Vanessa Zúñiga Tinizaray and used exclusively to show applications, processes, and possibilities of visual construction within the workshop context.
These three examples retain their independent authorship and protection and may not be reproduced, redistributed, reused as model exercises, or incorporated as teaching material by the User without the express, prior, written authorization of Vanessa Zúñiga Tinizaray.
6.4. Authorized personal use
The User may consult and use the materials delivered during the Workshop “Modularidad con Processing. Nivel I” as support for the User’s own learning, experimentation, and personal practice with AMUKI MODULAR. Visual Construction System. Versión 0.10.
This permission does not extend to their use as materials intended to teach, train, or educate other persons.
6.5. Unauthorized uses
Without the express, prior, written authorization of Vanessa Zúñiga Tinizaray, the User may not:
- a) reproduce the workshop presentation in whole or in substantial part;
- b) redistribute the exercises, instructions, support files, diagrams, examples, or other materials provided;
- c) use such materials to teach classes, courses, workshops, seminars, training sessions, academic subjects, or other educational processes;
- d) incorporate the content, structure, or pedagogical sequence of the workshop as the User’s own curricular material;
- e) present as their own the exercises, examples, materials, resources, or pedagogical structures developed by Vanessa Zúñiga Tinizaray;
- f) use content from Crónicas Visuales del Abya Yala as base material for exercises, demonstrations, or teaching processes directed at third parties;
- g) provide complete or substantial copies of the workshop materials to other persons, institutions, or platforms.
6.6. Quotations, references, and third-party materials
The User must respect the authorship and provenance of the different content shown during the workshop.
When referring to examples, images, code, or other materials from Generative Gestaltung. Creative Coding or any other external source, the attribution, licensing, and use conditions established by their respective authors or rightsholders must be respected.
With respect to original materials developed by Vanessa Zúñiga Tinizaray for the Workshop “Modularidad con Processing. Nivel I”, brief textual quotations, specific references, or limited excerpts may be used for legitimate purposes of analysis, research, or academic communication, provided that:
- a) Vanessa Zúñiga Tinizaray is correctly identified as the author;
- b) the source of the material is indicated;
- c) no substantial part of the presentation or original materials is reproduced;
- d) the complete presentation or other complete materials are not redistributed;
- e) and such use does not enable the original material to be substantially substituted or reconstructed.
The three (3) examples from Crónicas Visuales del Abya Yala shall additionally be subject to the specific restrictions established in section 6.3 of this license.
6.7. Independent development of teaching materials
Participation in the Workshop “Modularidad con Processing. Nivel I” does not prevent the User from subsequently developing their own exercises, examples, content, activities, or materials related to modularity, design, programming, or other related fields, provided that they are developed independently and do not reproduce, substantially adapt, redistribute, or reuse without authorization the pedagogical materials developed by Vanessa Zúñiga Tinizaray.
This provision, by itself, does not grant authorization to use AMUKI MODULAR. Visual Construction System. Versión 0.10 in teaching, training, or educational processes directed at third parties. Teaching use of the Tool shall be subject to the specific conditions established in Clause Eight of this license.
For teaching purposes, the User may independently use the original P_2_3_6_02 sketch, file P_2_3_6_02.pde, belonging to the Generative Gestaltung. Creative Coding project and authored by Hartmut Bohnacker, Benedikt Gross, Julia Laub, and Claudius Lazzeroni, provided that such use is carried out in accordance with the Apache License, Version 2.0, including the applicable authorship, copyright, license, and other notices and conditions.
Permission to use the original P_2_3_6_02 code derives exclusively from the Apache License, Version 2.0 and is independent of this license. Accordingly, that permission does not extend to AMUKI MODULAR. Visual Construction System. Versión 0.10, its proprietary code, architecture, interface, interaction systems, documentation, pedagogical methodology, or other developments created by Vanessa Zúñiga Tinizaray.
The specific conditions for using AMUKI MODULAR. Visual Construction System. Versión 0.10 in teaching contexts are established in Clause Eight of this license.
6.8. Independence between workshop materials and the Tool license
Access to the pedagogical materials of the Workshop “Modularidad con Processing. Nivel I” does not expand the rights granted over AMUKI MODULAR. Visual Construction System. Versión 0.10.
Likewise, holding an individual license for AMUKI MODULAR. Visual Construction System. Versión 0.10 does not automatically grant authorization to reproduce, reuse, redistribute, or teach using the pedagogical materials provided during the workshop.
The use of AMUKI MODULAR. Visual Construction System. Versión 0.10 in teaching or educational processes directed at third parties shall be governed specifically by Clause Eight of this license.
6.9. Acquisition of the license without participation in the workshop
The direct acquisition of an individual license for AMUKI MODULAR. Visual Construction System. Versión 0.10 without participation in the Workshop “Modularidad con Processing. Nivel I” does not include or create any right of access to the presentation, exercises, instructions, didactic sequences, support files, examples, documents, pedagogical materials, or any other content provided or used in that workshop.
The license for the Tool and access to the workshop materials constitute independent rights and benefits. Acquisition of an individual license for AMUKI MODULAR. Visual Construction System. Versión 0.10 does not imply acquisition of, a license to, or authorization to use the pedagogical materials of the Workshop “Modularidad con Processing. Nivel I”, unless those materials were expressly provided to the User as part of the User’s participation in that workshop.
Clause Seven
7. Permissions, authorized uses, and User rights
7.1. Individual permission to use
7.1.1. Under this license, Vanessa Zúñiga Tinizaray authorizes the User, on a limited, personal, individual, and non-exclusive basis, to use AMUKI MODULAR. Visual Construction System. Versión 0.10 in accordance with the terms, conditions, permissions, and restrictions established in this document.
7.1.2. The permissions granted under this license belong exclusively to the User who holds the license and do not extend to third parties.
7.2. Scope of the permissions granted
7.2.1. The User may use AMUKI MODULAR. Visual Construction System. Versión 0.10 for personal, academic, experimental, creative, research, and visual-production purposes.
7.2.2. The User may also explore, design, and develop their own modules, groups, sets, compositions, patterns, configurations, and visual systems through the functionalities available in AMUKI MODULAR. Visual Construction System. Versión 0.10.
7.2.3. The User may import into AMUKI MODULAR. Visual Construction System. Versión 0.10 resources and content compatible with the functionalities available in the Tool, provided that the User holds the necessary rights, licenses, or authorizations when such content belongs to third parties.
7.2.4. The User may save, retrieve, and export projects and results through the functionalities and formats available in AMUKI MODULAR. Visual Construction System. Versión 0.10.
7.3. Creation of proprietary systems and results
7.3.1. Use of AMUKI MODULAR. Visual Construction System. Versión 0.10 enables the User to develop original visual systems and compositions through the User’s own decisions regarding selection, organization, relationships, transformation, and construction.
7.3.2. Use of the functional structures, modes, relationships, and construction mechanisms provided by AMUKI MODULAR. Visual Construction System. Versión 0.10 does not make Vanessa Zúñiga Tinizaray an author or co-author of original creations developed by the User.
7.4. Rights in Final Works
7.4.1. Original Final Works created by the User through AMUKI MODULAR. Visual Construction System. Versión 0.10 belong to that User to the extent that they derive from the User’s own creative decisions and from content for which the User lawfully holds the necessary rights.
7.4.2. Accordingly, the User may exhibit, publish, reproduce, disseminate, license, and commercialize the User’s Final Works without requiring additional authorization from Vanessa Zúñiga Tinizaray.
7.4.3. Creation of a Final Work through AMUKI MODULAR. Visual Construction System. Versión 0.10 does not, by itself, create co-authorship, an economic interest, or any ownership right in favor of Vanessa Zúñiga Tinizaray in that work.
7.4.4. Recognition of the User’s rights in Final Works does not imply transfer of rights in AMUKI MODULAR. Visual Construction System. Versión 0.10.
When a Final Work is presented, published, documented, or communicated in an academic, research, exhibition, or professional context in which it is relevant to identify the process or tools used, it must acknowledge that it was developed using AMUKI MODULAR. Visual Construction System. Versión 0.10, in accordance with the attribution provisions established in Clause Five of this license.
Such acknowledgment identifies the Tool used in the creative process and does not imply authorship, co-authorship, or participation by Vanessa Zúñiga Tinizaray in the User’s Final Work.
7.5. Third-party content incorporated by the User
7.5.1. When a Final Work incorporates images, typefaces, SVG files, texts, videos, graphic, audiovisual, or digital resources, or other content belonging to third parties, the User shall be solely responsible for holding the rights, licenses, permissions, or authorizations necessary to use, transform, reproduce, publish, or commercialize them.
7.5.2. The technical use of such content through AMUKI MODULAR. Visual Construction System. Versión 0.10 does not grant the User additional rights over that content or modify the conditions established by its respective authors, rightsholders, or licenses.
7.5.3. Vanessa Zúñiga Tinizaray does not determine, verify, or guarantee that content incorporated by the User may lawfully be used, published, transformed, distributed, or commercialized.
7.6. Exclusions from the permissions granted
7.6.1. The permissions recognized to the User in relation to the User’s creations and Final Works do not extend to:
- a) AMUKI MODULAR. Visual Construction System. Versión 0.10 itself;
- b) the proprietary code developed by Vanessa Zúñiga Tinizaray;
- c) the functional architecture of the Tool;
- d) its interface and interaction systems;
- e) its documentation;
- f) the associated pedagogical methodology;
- g) the original materials provided during the Workshop “Modularidad con Processing. Nivel I”;
- h) the three examples from Crónicas Visuales del Abya Yala included in the workshop presentation;
- i) or any other proprietary content of Vanessa Zúñiga Tinizaray protected under this license.
7.6.2. The rights and conditions applicable to the original P_2_3_6_02 code and to other components belonging to third parties shall continue to be determined by their respective licenses and not by the exclusions established in the preceding section.
7.7. No assignment of rights in AMUKI MODULAR. Visual Construction System. Versión 0.10
7.7.1. This license does not imply assignment or transfer of any rights that belong to Vanessa Zúñiga Tinizaray in AMUKI MODULAR. Visual Construction System. Versión 0.10.
7.7.2. In particular, the rights granted to use AMUKI MODULAR. Visual Construction System. Versión 0.10 and to create works through it do not constitute authorization to reproduce it for distribution, redistribute it, sublicense it, make it available to third parties, commercialize it, exploit it as software, or use it under arrangements other than those expressly contemplated in this individual license.
Any use exceeding the scope of this license shall be subject to a different license previously negotiated and formalized in writing with Vanessa Zúñiga Tinizaray, which shall specifically establish the applicable conditions, scope, duration, number of Users, mode of use, and, where applicable, financial consideration.
Entering into such an additional license does not constitute an acquired right of the User or an obligation of Vanessa Zúñiga Tinizaray to grant it.
The foregoing is without prejudice to any independent rights applicable to third-party components subject to their respective licenses.
7.8. Independence between the Tool and the resulting work
7.8.1. AMUKI MODULAR. Visual Construction System. Versión 0.10 constitutes a means for visual construction and production.
7.8.2. Lawful use of AMUKI MODULAR. Visual Construction System. Versión 0.10 does not transfer rights in the Tool to the User and, reciprocally, use of the Tool does not transfer to Vanessa Zúñiga Tinizaray rights in original works created by the User.
7.9. Interpretation in accordance with this license
7.9.1. The permissions recognized in this clause shall be interpreted together with the other provisions of this license and may not be understood as authorization to engage in uses expressly restricted in other clauses.
7.9.2. The specific conditions relating to teaching, instruction, and use of AMUKI MODULAR. Visual Construction System. Versión 0.10 by students or third parties are governed by Clause Eight.
Clause Eight
8. Teaching, instruction, and educational use
8.1. Scope of the individual license in teaching contexts
8.1.1. Participation in the Workshop “Modularidad con Processing. Nivel I” and obtaining an individual license for AMUKI MODULAR. Visual Construction System. Versión 0.10 do not, by themselves, authorize sharing, distributing, lending, reproducing, or making the licensed copy available to students, participants, or third parties.
8.1.2. The individual license belongs exclusively to its holder. Accordingly, an instructor may not use their own copy of AMUKI MODULAR. Visual Construction System. Versión 0.10 as a collective, shared, or common copy so that other persons may access, install, or use the Tool.
8.2. Teaching use of the original reference code
8.2.1. Persons interested in teaching content related to modularity, programming, or generative design may independently use the original P_2_3_6_02 sketch, file P_2_3_6_02.pde, belonging to the Generative Gestaltung. Creative Coding project and authored by Hartmut Bohnacker, Benedikt Gross, Julia Laub, and Claudius Lazzeroni, provided that they comply with the conditions established in the Apache License, Version 2.0, including the applicable copyright, authorship, license, and attribution notices.
8.2.2. The right to use, modify, or teach using the original P_2_3_6_02 code derives exclusively from the Apache License, Version 2.0 and is entirely independent of this license.
8.2.3. Accordingly, lawful teaching use of the original P_2_3_6_02 code does not require authorization from Vanessa Zúñiga Tinizaray, provided that such use is limited to material subject to the Apache License, Version 2.0 and fully complies with its conditions.
8.2.4. The permission established by the Apache License, Version 2.0 with respect to the original P_2_3_6_02 code does not automatically extend to AMUKI MODULAR. Visual Construction System. Versión 0.10, nor to the proprietary developments, functional architecture, organizational systems, interface, documentation, pedagogical materials, or methodology developed by Vanessa Zúñiga Tinizaray.
8.3. Use of AMUKI MODULAR. Visual Construction System. Versión 0.10 in teaching processes
8.3.1. AMUKI MODULAR. Visual Construction System. Versión 0.10 may be used as a tool within a course, workshop, academic subject, seminar, or other educational process when each person who installs, executes, or directly uses the Tool holds their own valid individual license, or when such use is expressly covered by a specific license previously negotiated and formalized in writing with Vanessa Zúñiga Tinizaray.
8.3.2. When the educational process is carried out through individual licenses, an instructor’s individual license does not cover or replace the individual licenses of their students or participants.
8.3.3. Under that arrangement, each student or participant who uses AMUKI MODULAR. Visual Construction System. Versión 0.10 must have lawfully obtained their own license and must individually comply with the terms and conditions established in this license.
8.3.4. The instructor may not provide students or participants with:
- a) the instructor’s own copy of AMUKI MODULAR. Visual Construction System. Versión 0.10;
- b) installation files corresponding to the instructor’s license;
- c) private delivery folders;
- d) credentials or personal access mechanisms;
- e) copies of the proprietary code of AMUKI MODULAR. Visual Construction System. Versión 0.10;
- f) or any other mechanism intended to allow multiple persons to use a single individual license.
8.3.5. The fact that all participants hold a valid individual license for AMUKI MODULAR. Visual Construction System. Versión 0.10 permits use of the Tool within the educational process, but does not authorize the instructor to reproduce, reuse, or teach with the original pedagogical materials of the Workshop “Modularidad con Processing. Nivel I”.
8.3.6. In particular, teaching use of AMUKI MODULAR. Visual Construction System. Versión 0.10 does not authorize reproduction or reuse of the presentation, exercises, didactic sequences, support files, proprietary examples, content from Crónicas Visuales del Abya Yala, or other protected materials developed by Vanessa Zúñiga Tinizaray.
8.3.7. Likewise, use of AMUKI MODULAR. Visual Construction System. Versión 0.10 in an educational process does not make the instructor an authorized instructor, official trainer, partner, certifier, distributor, or representative of Vanessa Zúñiga Tinizaray, unless there is a specific prior written agreement expressly establishing that status.
8.4. Development of the instructor’s own teaching materials
8.4.1. An instructor may develop their own exercises, examples, content, activities, and pedagogical materials related to modularity, design, programming, or visual construction.
8.4.2. When such processes use AMUKI MODULAR. Visual Construction System. Versión 0.10, the licensing conditions established in sections 8.3 and 8.5, as applicable, must be observed.
8.4.3. Materials developed by the instructor must be original and independent and may not consist of the unauthorized reproduction, substantial adaptation, redistribution, or reuse of pedagogical materials developed by Vanessa Zúñiga Tinizaray.
8.5. Institutional, collective, or multiple-license use
8.5.1. When a university, educational institution, company, organization, laboratory, collective, or other entity wishes to use AMUKI MODULAR. Visual Construction System. Versión 0.10 institutionally or collectively, or to acquire or manage multiple licenses for such use, a specific license must first be negotiated and formalized with Vanessa Zúñiga Tinizaray.
8.5.2. The following are included within this category, by way of example and without limitation:
- a) installations in laboratories, classrooms, or shared-use devices;
- b) centrally managed institutional installations;
- c) licenses intended for groups, courses, cohorts, or academic programs;
- d) use of AMUKI MODULAR. Visual Construction System. Versión 0.10 by groups of students within degree-completion processes, degree projects, theses, master’s programs, specializations, postgraduate programs, or doctoral programs when access is collectively provided, managed, or funded by an institution, program, project, or group;
- e) use by research groups or teams, institutional projects, research laboratories, observatories, research seedbeds, academic collectives, or other research units;
- f) joint use by students, instructors, supervisors, thesis directors, researchers, research assistants, or other participants in the same project when access to the Tool is provided, administered, or licensed collectively rather than through valid individual licenses corresponding to each User;
- g) institutional distribution of AMUKI MODULAR. Visual Construction System. Versión 0.10 to students, instructors, researchers, academic staff, or administrative personnel;
- h) use through shared accounts, devices, facilities, or access mechanisms;
- i) incorporation of AMUKI MODULAR. Visual Construction System. Versión 0.10 as a permanent or recurring resource within an academic program, degree program, master’s program, specialization, doctoral program, research project, laboratory, or institutional unit;
- j) acquisition or management of multiple licenses by a university, educational institution, research center, company, organization, or project;
- k) and any other form of use that exceeds the scope of an individual license.
8.5.3. Individual academic use in degree-completion and research processes
Individual completion of a thesis, degree-completion project, master’s research project, specialization, postgraduate program, or doctoral research using AMUKI MODULAR. Visual Construction System. Versión 0.10 does not require an additional license when the researcher holds a valid individual license and is the only person who installs and directly uses the Tool.
Participation by supervisors, thesis directors, instructors, or researchers solely in advisory, review, or supervision roles does not by itself require a license. When any such person needs to install, execute, or directly use AMUKI MODULAR. Visual Construction System. Versión 0.10, that person must hold their own valid individual license or be covered by a specific licensing arrangement.
8.5.4. The specific license shall establish, as applicable, the number of Users, authorized scope, duration, mode of access, installation conditions, teaching or institutional use, and financial consideration.
8.5.5. The possibility of requesting an institutional, collective, or other license different from the individual license does not constitute an acquired right and does not create an obligation for Vanessa Zúñiga Tinizaray to grant it. Its terms must be agreed in advance and formalized in writing.
8.6. Independence between teaching with the original code and teaching with AMUKI MODULAR. Visual Construction System. Versión 0.10
8.6.1. To avoid any ambiguous interpretation, it is expressly established that there are two independent regimes:
- a) the original P_2_3_6_02 sketch, by Hartmut Bohnacker, Benedikt Gross, Julia Laub, and Claudius Lazzeroni, may be used for teaching purposes in accordance with the Apache License, Version 2.0;
- b) AMUKI MODULAR. Visual Construction System. Versión 0.10 is subject to this license and may be directly used by students or participants only when each person holds the corresponding license or when another licensing arrangement has been previously negotiated and formalized with Vanessa Zúñiga Tinizaray.
8.6.2. The authorization granted by the Apache License, Version 2.0 with respect to the original code does not constitute authorization to reproduce, distribute, teach using unlicensed copies of, or make AMUKI MODULAR. Visual Construction System. Versión 0.10 available to third parties.
Clause Nine
9. Restrictions and unauthorized uses
9.1. General principle
Without prejudice to the rights that apply to the original P_2_3_6_02 code and to other third-party components subject to their respective licenses, it is prohibited to use AMUKI MODULAR. Visual Construction System. Versión 0.10 or Vanessa Zúñiga Tinizaray’s proprietary developments in any manner other than the uses expressly authorized under this license.
Uses that exceed the scope of this individual license shall, where eligible for authorization, require a specific license previously negotiated and formalized in writing with Vanessa Zúñiga Tinizaray.
9.2. Distribution, assignment, and third-party access
The User may not:
- a) sell, resell, sublicense, assign, share, lend, rent, lease, give away, or redistribute AMUKI MODULAR. Visual Construction System. Versión 0.10, in whole or in part;
- b) provide third parties with installation copies, executable files, delivery folders, internal files, the Author’s proprietary code, or any other protected component of AMUKI MODULAR. Visual Construction System. Versión 0.10;
- c) share private download links, credentials, folders, repositories, storage services, or any other mechanism used to access the Tool;
- d) allow another person to use the User’s individual license, even if such access is temporary, free of charge, or occurs within a family, academic, professional, or employment relationship;
- e) install or facilitate use of the same license in classrooms, laboratories, shared devices, institutions, organizations, or collective environments outside the conditions expressly permitted under this license.
9.3. Publication and making available
The User may not publish, host, distribute, or make AMUKI MODULAR. Visual Construction System. Versión 0.10 available to third parties, in whole or in part, through:
- a) public or private repositories intended for third-party access;
- b) websites;
- c) educational platforms;
- d) cloud services;
- e) download systems;
- f) applications;
- g) plugins;
- h) digital services;
- i) software platforms;
- j) or any other distribution or access mechanism.
9.4. Modification and use of the Author’s proprietary developments
The individual license does not authorize the User to modify, adapt, alter, replace, or intervene in the proprietary code, functional architecture, organizational structures, interface, interaction systems, documentation, or other original developments of Vanessa Zúñiga Tinizaray incorporated into AMUKI MODULAR. Visual Construction System. Versión 0.10, unless a specific license has been previously negotiated and formalized in writing with Vanessa Zúñiga Tinizaray.
Likewise, the individual license does not authorize the use of such proprietary developments, in whole or in part, to create, reproduce, or develop another tool, application, platform, plugin, service, visual construction system, or software product intended for third parties.
Nor does it authorize the redistribution, publication, making available to third parties, or commercialization of modified versions of AMUKI MODULAR. Visual Construction System. Versión 0.10.
Nothing in this section limits or modifies rights that the Apache License, Version 2.0 or other third-party licenses directly grant with respect to their own components.
9.5. Artificial intelligence platforms and automated services
The User may not provide, upload, copy, transmit, input, or make available, in whole or in part, the proprietary code, internal files, internal architecture, protected documentation, or other protected components of AMUKI MODULAR. Visual Construction System. Versión 0.10 to:
- a) artificial intelligence platforms or systems;
- b) programming assistants;
- c) generative models;
- d) automated services for code generation, analysis, transformation, correction, or modification;
- e) services intended for model training, fine-tuning, or evaluation;
- f) or other third-party services that require transmitting, storing, processing, or analyzing such components.
This restriction covers both direct provision of the content and its use within queries, prompts, attached files, projects, connected repositories, or other mechanisms through which a third party or external system may access the protected material.
Any use of this nature shall, where eligible for authorization, require a specific license previously negotiated and formalized in writing with Vanessa Zúñiga Tinizaray.
This restriction does not apply to rights that independently arise in relation to the original P_2_3_6_02 code subject to the Apache License, Version 2.0 or to other third-party components subject to their own licenses.
9.6. Alteration of authorship and license notices
The User may not remove, conceal, replace, or modify authorship, copyright, license, credit, legal-reference, or identifying notices incorporated into AMUKI MODULAR. Visual Construction System. Versión 0.10.
This prohibition includes, among other things, any alteration that could:
- a) present it as a tool belonging to the User or to third parties;
- b) conceal its provenance;
- c) enable redistribution without identification of its Author;
- d) create confusion regarding its ownership;
- e) or circumvent the conditions established in this license.
Notices corresponding to third-party components must be maintained in accordance with their respective licenses.
9.7. Authorship and representation
The User may not present as their own or attribute to third parties:
- a) AMUKI MODULAR. Visual Construction System. Versión 0.10;
- b) its proprietary developments;
- c) its functional architecture;
- d) its interface;
- e) its organizational and interaction systems;
- f) its documentation;
- g) or the pedagogical methodology developed by Vanessa Zúñiga Tinizaray.
Likewise, the User may not present themselves as a representative, official developer, partner, distributor, certified trainer, or person authorized to represent AMUKI MODULAR. Visual Construction System. Versión 0.10, unless there is a specific written agreement expressly establishing that status.
9.8. Unauthorized teaching use
The User may not provide their copy of AMUKI MODULAR. Visual Construction System. Versión 0.10 to students, participants, or third parties for use in teaching, training, or educational processes.
Teaching use of AMUKI MODULAR. Visual Construction System. Versión 0.10 must comply with the conditions established in Clause Eight of this license.
This restriction does not limit independent use of the original P_2_3_6_02 code by Hartmut Bohnacker, Benedikt Gross, Julia Laub, and Claudius Lazzeroni when such use is carried out in accordance with the Apache License, Version 2.0.
9.9. Use of name, identity, and promotional materials
The User may not use the name AMUKI MODULAR. Visual Construction System. Versión 0.10, the name Vanessa Zúñiga Tinizaray, logos, visual identity, interface images, graphic materials, or promotional elements of the Tool in a manner that implies sponsorship, representation, certification, association, institutional support, or endorsement by Vanessa Zúñiga Tinizaray where no such relationship exists.
This provision does not prevent the legitimate identification of AMUKI MODULAR. Visual Construction System. Versión 0.10 as the tool used in a work, research project, publication, or project, in accordance with the attribution obligations established in this license.
9.10. Works created by the User
The restrictions established in this clause do not affect the rights recognized to the User in Final Works lawfully created through AMUKI MODULAR. Visual Construction System. Versión 0.10, in accordance with Clause Seven.
The User may use, publish, and commercialize their own Final Works without this constituting redistribution or exploitation of the Tool.
9.11. Breach
Breach of the restrictions established in this clause may result in termination of the permissions granted under this license, in accordance with the conditions established in Clause Ten, without prejudice to any rights and remedies available under applicable law.
Clause Ten
10. Duration, termination, and effects of the license
10.1. Duration of the license
This license is granted for an indefinite period exclusively with respect to AMUKI MODULAR. Visual Construction System. Versión 0.10, provided that the User complies with the terms, conditions, obligations, and restrictions established in this document.
The indefinite nature of the license applies solely to the right to use AMUKI MODULAR. Visual Construction System. Versión 0.10 and does not imply a right to receive subsequent versions, new functionalities, new generations of the Tool, or future licensing arrangements.
Conditions relating to updates, corrections, and subsequent versions are specifically governed by Clause Eleven.
10.2. Termination for breach
A material breach of the obligations, restrictions, or prohibitions established in this license may result in termination of the rights of use granted over AMUKI MODULAR. Visual Construction System. Versión 0.10, without prejudice to any actions available under applicable law.
The following breaches, among others, shall be considered particularly significant:
- a) unauthorized redistribution or delivery of AMUKI MODULAR. Visual Construction System. Versión 0.10;
- b) assignment, lending, sublicensing, or use of an individual license by third parties;
- c) unauthorized publication or making available of the Tool’s proprietary code, internal files, or protected components;
- d) use of Vanessa Zúñiga Tinizaray’s proprietary developments to create or distribute another tool or software product contrary to the conditions of this license;
- e) unauthorized exposure of proprietary code, internal files, internal architecture, protected documentation, or other protected components to artificial intelligence platforms, programming assistants, automated services, or other third-party systems, in accordance with Clause Nine;
- f) intentional removal or concealment of authorship, copyright, license, or identification notices;
- g) unauthorized use of an individual license in collective, institutional, or shared arrangements;
- h) and any other conduct that materially violates the rights or restrictions established in this license.
10.3. Effects of termination
Upon termination of the license for breach, the User must cease using AMUKI MODULAR. Visual Construction System. Versión 0.10 and delete all copies of the Tool under the User’s possession or control, including active installations and backup copies.
Termination of the license does not authorize the User to retain a functional copy for continued use.
Only documents or files whose retention is legally necessary as evidence in an administrative, judicial, or dispute-resolution proceeding may be retained, without such retention authorizing ordinary use.
10.4. Works and projects created before termination
Termination of the license does not affect rights lawfully acquired by the User in original Final Works created before termination, provided that such works were produced in accordance with the conditions established in this license.
The User may continue to use, exhibit, publish, or commercialize such Final Works in accordance with Clause Seven and the rights lawfully held in the content incorporated into them.
Termination of the license likewise does not transfer to Vanessa Zúñiga Tinizaray any rights in original works created by the User.
10.5. Survival of certain obligations
Termination of the license does not extinguish obligations that, by their nature, must continue to have effect after termination.
In particular, the following provisions shall remain applicable:
- a) authorship and intellectual property;
- b) attribution, where applicable;
- c) prohibition on redistribution of material obtained during the term of the license;
- d) protection of pedagogical materials;
- e) responsibility for third-party content;
- f) limitations of liability;
- g) and any other provisions that, by their nature, must remain in force after termination of the right of use.
10.6. Rights arising from third-party licenses
Termination of this license affects only the rights granted by Vanessa Zúñiga Tinizaray with respect to AMUKI MODULAR. Visual Construction System. Versión 0.10 and her own authorial contributions.
Termination does not modify or extinguish any rights that the User may independently exercise in relation to the original P_2_3_6_02 code or other third-party components under the Apache License, Version 2.0 or the licenses respectively applicable to them.
Clause Eleven
11. Versions, corrections, updates, and scope of the license
11.1. Version covered by the license
This license applies exclusively to AMUKI MODULAR. Visual Construction System. Versión 0.10, delivered to the User as part of the Workshop “Modularidad con Processing. Nivel I”, through direct acquisition of an individual license, or through another individual arrangement authorized by Vanessa Zúñiga Tinizaray.
The right of use granted under this license remains tied to AMUKI MODULAR. Visual Construction System. Versión 0.10 and does not automatically extend to subsequent versions of the Tool.
11.2. Ongoing development of the Tool
AMUKI MODULAR. Visual Construction System. Versión 0.10 forms part of an ongoing process of research, design, and development carried out by Vanessa Zúñiga Tinizaray.
Accordingly, the Tool may be subject to technical adjustments, bug fixes, stability improvements, internal modifications, functional refinements, and other interventions inherent to its development process.
The existence of this ongoing process does not imply that AMUKI MODULAR. Visual Construction System. Versión 0.10 is free from errors, incompatibilities, or unforeseen technical behaviors.
11.3. Corrections corresponding to Versión 0.10
When Vanessa Zúñiga Tinizaray identifies an error, incident, or technical problem corresponding to the original version of AMUKI MODULAR. Visual Construction System. Versión 0.10, she may develop and make available to Users a correction or maintenance revision when she considers it technically appropriate and according to her availability.
Corrections that Vanessa Zúñiga Tinizaray expressly determines to belong to AMUKI MODULAR. Visual Construction System. Versión 0.10 may be delivered to persons holding a valid license for that version, without this constituting the grant of a license for a future version.
11.4. No mandatory correction timeframes
This license does not establish fixed response, diagnosis, development, correction, or solution-delivery times.
The identification or communication of an incident by a User does not create an obligation to correct it immediately or within a specific period.
Vanessa Zúñiga Tinizaray shall determine, according to the nature of the incident, the technical conditions of the Tool, her development priorities, and her availability, the time and manner in which a problem corresponding to AMUKI MODULAR. Visual Construction System. Versión 0.10 may be analyzed or corrected.
11.5. Corrections and new functionalities
A technical correction, stability adjustment, bug repair, or internal revision that Vanessa Zúñiga Tinizaray determines to be part of AMUKI MODULAR. Visual Construction System. Versión 0.10 does not create a right to receive new functionalities, substantial extensions, new tools, new systems, new training levels, or subsequent developments.
The Author shall determine when a modification constitutes maintenance of AMUKI MODULAR. Visual Construction System. Versión 0.10 and when it constitutes a new version of the Tool.
11.6. Future versions
The license for AMUKI MODULAR. Visual Construction System. Versión 0.10 does not grant an automatic right to access, receive, download, install, use, or claim future versions of the Tool.
This exclusion includes any subsequent version that Vanessa Zúñiga Tinizaray identifies as a new version, regardless of whether it maintains conceptual, visual, technical, or functional continuity with AMUKI MODULAR. Visual Construction System. Versión 0.10.
11.7. New versions and new training levels
Ongoing development of the Tool may give rise to new versions, extensions, configurations, complementary tools, or new levels of the Workshop “Modularidad con Processing”.
Each new version or level may have its own functionalities, access conditions, scope of use, license, and price.
Participation in the Workshop “Modularidad con Processing. Nivel I” and the license for AMUKI MODULAR. Visual Construction System. Versión 0.10 do not create any acquired right in relation to such subsequent developments.
11.8. Access to subsequent versions
Access to subsequent versions of the Tool may occur only under the conditions that Vanessa Zúñiga Tinizaray establishes for each new version. Such conditions may include, as applicable:
- a) participation in a new edition or level of the workshop;
- b) acquisition of a new license;
- c) an update under specific conditions;
- d) entering into an individual, teaching, institutional, or other type of agreement;
- e) or any other form of access defined by Vanessa Zúñiga Tinizaray.
The existence of a prior license does not obligate Vanessa Zúñiga Tinizaray to offer preferential conditions, free updates, or automatic access to subsequent versions.
11.9. Modifications made by the User
The corrections and updates contemplated in this clause refer to the version lawfully delivered by Vanessa Zúñiga Tinizaray.
When AMUKI MODULAR. Visual Construction System. Versión 0.10 has been modified, altered, or intervened in by the User or by third parties, the technical consequences of such modifications shall not be considered defects of the original version delivered by the Author.
The liability and support conditions applicable to modified copies are specifically established in Clause Thirteen of this license.
11.10. Independence between the indefinite license and future updates
The indefinite nature of the license established in Clause Ten means that the User may continue lawfully using AMUKI MODULAR. Visual Construction System. Versión 0.10 for as long as the User complies with the conditions of this license.
That indefinite nature does not convert the license into a maintenance subscription, a permanent support service, or a right of access to future developments.
Clause Twelve
12. Nature of the license, ownership, and resulting works
12.1. Nature of the license
AMUKI MODULAR. Visual Construction System. Versión 0.10 is not transferred to the User as intellectual property or as software whose ownership is acquired through participation in the workshop, payment for a license, or any other authorized form of access.
The User receives solely a right to use AMUKI MODULAR. Visual Construction System. Versión 0.10, subject to the terms, conditions, permissions, and restrictions established in this license.
Any payment corresponding to the workshop, the license, or any authorized form of access does not constitute a sale of the intellectual property rights in AMUKI MODULAR. Visual Construction System. Versión 0.10.
12.2. No assignment of rights
This license does not imply assignment, transfer, sale, or waiver of the rights that belong to Vanessa Zúñiga Tinizaray in her own authorial contributions incorporated into AMUKI MODULAR. Visual Construction System. Versión 0.10.
In particular, the User does not acquire ownership rights in:
- a) the proprietary code developed by Vanessa Zúñiga Tinizaray;
- b) the functional architecture of the Tool;
- c) the organizational and interaction systems;
- d) the interface;
- e) the documentation;
- f) the pedagogical methodology;
- g) the proprietary materials associated with the Workshop “Modularidad con Processing. Nivel I”;
- h) or any other original developments protected under this license.
The foregoing is without prejudice to any independent rights applicable to the original P_2_3_6_02 code and other third-party components subject to their respective licenses.
12.3. Ownership of Final Works
Original Final Works created by the User through AMUKI MODULAR. Visual Construction System. Versión 0.10 belong to that User, provided that they derive from the User’s own creative decisions and from content for which the User lawfully holds the necessary rights.
Accordingly, the User may exhibit, publish, reproduce, disseminate, license, and commercialize such Final Works in accordance with Clause Seven.
Use of AMUKI MODULAR. Visual Construction System. Versión 0.10 as a means of creation does not make Vanessa Zúñiga Tinizaray an author or co-author of original works produced by the User.
12.4. Identification of the Tool used
Recognition of the User’s rights in Final Works does not eliminate the obligation to identify AMUKI MODULAR. Visual Construction System. Versión 0.10 when, under Clauses Five and Seven, it is appropriate to identify the Tool used in an academic, research, exhibition, documentary, or professional context.
Such identification acknowledges exclusively the Tool used in the creative process and does not imply participation by Vanessa Zúñiga Tinizaray in the authorship of the Final Work.
12.5. Content incorporated by the User
The rights recognized in Final Works do not imply that Vanessa Zúñiga Tinizaray guarantees ownership of or lawful rights in images, typefaces, SVG files, videos, texts, graphic, audiovisual, or digital resources, or other content incorporated by the User into AMUKI MODULAR. Visual Construction System. Versión 0.10.
The User shall be solely responsible for holding the licenses, permissions, authorizations, or rights necessary for such content.
The fact that AMUKI MODULAR. Visual Construction System. Versión 0.10 technically permits the import, display, organization, transformation, or use of a particular file or resource does not constitute authorization, a license, or a guarantee by Vanessa Zúñiga Tinizaray regarding rights applicable to that content.
12.6. Independence between the Tool and User content
Modules, groups, sets, compositions, patterns, projects, and other original content created by the User through AMUKI MODULAR. Visual Construction System. Versión 0.10 do not become the property of Vanessa Zúñiga Tinizaray merely because they were developed using the Tool.
Reciprocally, creation of such content does not grant the User ownership rights in AMUKI MODULAR. Visual Construction System. Versión 0.10 or in Vanessa Zúñiga Tinizaray’s proprietary developments.
12.7. Independence from third-party components
No provision of this clause modifies the conditions applicable to the original P_2_3_6_02 code by Hartmut Bohnacker, Benedikt Gross, Julia Laub, and Claudius Lazzeroni, or to other third-party components used by AMUKI MODULAR. Visual Construction System. Versión 0.10.
Rights corresponding to such components shall continue to be determined by the Apache License, Version 2.0 or the licenses respectively applicable to them.
Clause Thirteen
13. Disclaimer of warranties, technical support, and limitation of liability
13.1. Delivery of the Tool
AMUKI MODULAR. Visual Construction System. Versión 0.10 is delivered to the User in the technical condition in which it exists at the time of delivery, on an “AS IS” basis, without warranty of uninterrupted operation, absolute absence of errors, universal compatibility, permanent availability, or fitness for a particular purpose, except for warranties or liabilities that may not be excluded under applicable law.
The User acknowledges that, like any software undergoing continuous development, AMUKI MODULAR. Visual Construction System. Versión 0.10 may present errors, unforeseen technical behaviors, incompatibilities, or incidents requiring review or correction.
13.2. Correction of incidents in the original version
When Vanessa Zúñiga Tinizaray identifies a technical incident corresponding to the original version of AMUKI MODULAR. Visual Construction System. Versión 0.10, she may analyze it, correct it, or publish a maintenance revision according to her technical judgment, development process, and availability.
Communication of an incident by a User does not create an obligation to diagnose, respond, correct, or deliver a solution within a specified period.
The conditions relating to corrections and updates of AMUKI MODULAR. Visual Construction System. Versión 0.10 are set out in Clause Eleven.
13.3. Nature of technical support
This license does not include a permanent, immediate, or continuous technical support service, nor one subject to specific response or resolution times.
Vanessa Zúñiga Tinizaray may provide guidance, assistance, or technical support related to AMUKI MODULAR. Visual Construction System. Versión 0.10 when she considers it appropriate and according to her availability.
The occasional provision of technical assistance does not create an obligation to maintain such service in the future or establish a permanent support commitment.
13.4. Modifications made by the User or third parties
Vanessa Zúñiga Tinizaray shall not be liable for errors, malfunctions, loss of functionality, file corruption, data loss, incompatibilities, behavioral changes, or any other problem caused by modifications, interventions, or alterations made by the User or third parties to AMUKI MODULAR. Visual Construction System. Versión 0.10.
This exclusion includes, among other circumstances, modifications made:
- a) directly to the code or internal files of the Tool;
- b) through editors, programming environments, or other development tools;
- c) through programming assistants;
- d) through artificial intelligence platforms, models, or systems;
- e) through automated services for code generation, analysis, correction, or transformation;
- f) through the replacement, deletion, or alteration of files, libraries, dependencies, or resources necessary for operation of the Tool;
- g) or through any other procedure that modifies the original version delivered by Vanessa Zúñiga Tinizaray.
13.5. Modified copies
When a copy of AMUKI MODULAR. Visual Construction System. Versión 0.10 has been modified, intervened in, or altered from the original version delivered by Vanessa Zúñiga Tinizaray, the Author does not guarantee its stability, operation, compatibility, integrity, or recoverability.
Incidents resulting from such modifications shall not be considered defects of the original version of AMUKI MODULAR. Visual Construction System. Versión 0.10.
Vanessa Zúñiga Tinizaray shall not be obligated to repair, restore, debug, reconstruct, or provide technical support for copies modified by the User or third parties.
Any assistance she may eventually provide regarding a modified copy shall be subject exclusively to her judgment, availability, and the conditions she determines for each case.
13.6. Technical environment and compatibility
The operation of AMUKI MODULAR. Visual Construction System. Versión 0.10 may depend on factors external to Vanessa Zúñiga Tinizaray, including, among others:
- a) operating system;
- b) Processing version;
- c) Java;
- d) graphics drivers;
- e) hardware;
- f) third-party libraries and dependencies;
- g) file formats;
- h) system configurations;
- i) changes introduced by manufacturers or developers of external software;
- j) and subsequent updates to the User’s computing environment.
Accordingly, Vanessa Zúñiga Tinizaray does not guarantee that AMUKI MODULAR. Visual Construction System. Versión 0.10 will remain indefinitely compatible with future changes made by third parties to operating systems, hardware, Processing, Java, libraries, drivers, or other external dependencies.
13.7. Responsibility for files, projects, and backups
The User shall be responsible for maintaining adequate backup copies of projects, original files, imported resources, and results generated through AMUKI MODULAR. Visual Construction System. Versión 0.10.
To the maximum extent permitted by applicable law, Vanessa Zúñiga Tinizaray shall not be liable for loss, corruption, deletion, or inability to recover projects, files, or content when such effects result from failures in the computing environment, operating errors, modifications made by the User, hardware damage, third-party software, absence of backup copies, or other circumstances beyond her reasonable control.
13.8. Content incorporated by the User
Vanessa Zúñiga Tinizaray does not verify or guarantee ownership, lawfulness, provenance, licensing, or authorization relating to images, typefaces, SVG files, videos, texts, graphic, audiovisual, or digital resources, or other content that the User incorporates into AMUKI MODULAR. Visual Construction System. Versión 0.10.
The User shall be solely responsible for determining whether the User holds the rights necessary to use, transform, publish, distribute, or commercialize such content.
Vanessa Zúñiga Tinizaray shall not be liable for claims, infringements, or disputes arising from unauthorized use of third-party content incorporated by the User.
13.9. Results obtained through the Tool
AMUKI MODULAR. Visual Construction System. Versión 0.10 is a visual construction tool and does not guarantee the achievement of specific creative, academic, professional, commercial, or technical results.
The assessment, suitability, originality, relevance, quality, and use of results generated through the Tool are the sole responsibility of the User.
13.10. General limitation of liability
To the maximum extent permitted by applicable law, Vanessa Zúñiga Tinizaray shall not be liable for damages, losses, business interruption, loss of information, loss of opportunities, incompatibilities, unexpected results, or other consequences arising from the use, misuse, or inability to use AMUKI MODULAR. Visual Construction System. Versión 0.10 when such consequences are not legally attributable to the Author under applicable law.
No provision of this clause shall be interpreted as excluding or limiting liabilities that, under the laws in force in the Republic of Ecuador, may not legally be excluded or limited.
13.11. Responsibilities of the User
The User is responsible for:
- a) using AMUKI MODULAR. Visual Construction System. Versión 0.10 in accordance with this license;
- b) maintaining periodic backup copies of projects and files;
- c) retaining the original files of incorporated resources;
- d) verifying the licenses and rights applicable to third-party content;
- e) verifying compatibility of the User’s equipment and technical environment;
- f) avoiding unauthorized modifications to the Tool;
- g) assuming the consequences arising from interventions made by the User or third parties to the User’s copy;
- h) and evaluating the suitability of AMUKI MODULAR. Visual Construction System. Versión 0.10 for the specific project or purpose for which the User chooses to use it.
13.12. Privacy and absence of data collection by the Tool
AMUKI MODULAR. Visual Construction System. Versión 0.10 is not designed to collect, transmit, or provide to Vanessa Zúñiga Tinizaray personal data, telemetry, usage analytics, or content from projects developed by the User.
Vanessa Zúñiga Tinizaray does not access, through the Tool, the projects, files, images, typefaces, resources, or other content incorporated or generated by the User.
This provision refers exclusively to the operation of AMUKI MODULAR. Visual Construction System. Versión 0.10 and does not include services, platforms, operating systems, or third-party tools that the User independently chooses to use.
Clause Fourteen
14. Legal information, effectiveness, and identification of the license
14.1. Applicable license
This document constitutes the complete license applicable to AMUKI MODULAR. Visual Construction System. Versión 0.10 and forms part of the documentation associated with its delivery.
The conditions contained in this license govern exclusively the version expressly identified as AMUKI MODULAR. Visual Construction System. Versión 0.10 and do not automatically extend to subsequent versions of the Tool.
14.2. Effective date
This license becomes effective with respect to each User from the moment that User installs, executes, accesses, or uses AMUKI MODULAR. Visual Construction System. Versión 0.10.
Use of the Tool constitutes acceptance of the terms and conditions established in this license, as stated in the Preliminary Section.
14.3. Identification of the license granted
The copy of the license delivered together with AMUKI MODULAR. Visual Construction System. Versión 0.10 evidences the version of the Tool and the conditions under which the User’s right of use was initially granted.
That copy may also be retained as documentary evidence of the license received.
However, for purposes of consultation, correction of material or typographical errors, numbering issues, updating references, and other adjustments that do not alter the meaning, scope, rights, or obligations of the license granted, the official and current version of the license text shall be the version published on Vanessa Zúñiga Tinizaray’s official website, in accordance with section 14.5.
Publication of an updated version of the license does not, by itself, grant rights in subsequent versions of the Tool or modify the scope of the originally licensed version of the Tool.
14.4. Copies of the license
The license may be provided in digital format, PDF, electronic document, website, or another medium used by Vanessa Zúñiga Tinizaray to accompany delivery of AMUKI MODULAR. Visual Construction System. Versión 0.10.
Reproduction of the license for consultation, archival, or evidentiary purposes does not modify its content or grant additional rights in the Tool.
14.5. Official version of the document
The official, current, and updated version of the license corresponding to AMUKI MODULAR. Visual Construction System. Versión 0.10 shall be the version published on Vanessa Zúñiga Tinizaray’s official website:
Copies of the license delivered in PDF, printed, digital, attached, or other format shall have documentary and reference value.
If there are material errors, typographical errors, numbering issues, outdated references, or other differences among copies of the license that do not alter the meaning, scope, rights, or obligations corresponding to the license granted, the current text published on the official website shall prevail as the official reference.
The User may consult on that website the official and updated version of the conditions applicable to AMUKI MODULAR. Visual Construction System. Versión 0.10.
The precedence of the text published on the official website over other copies shall be understood within the limits established in section 14.6 and shall not, by itself, constitute a retroactive modification of rights or obligations previously granted.
14.6. Corrections and updates to the license
Vanessa Zúñiga Tinizaray may correct or update this license when necessary to remedy material or typographical errors, correct numbering issues, update legal or technical references, or make other adjustments that do not alter the meaning, scope, rights, or obligations corresponding to a license already granted.
Such corrections and updates shall be incorporated into the official version published on the website identified in section 14.5.
Any modification that alters the meaning or scope of the rights or obligations corresponding to a license already granted shall not apply retroactively to the User unless the User expressly accepts it or a mandatory legal provision requires otherwise.
Future versions of the Tool that Vanessa Zúñiga Tinizaray identifies as distinct versions may be subject to new licensing conditions, in accordance with Clause Eleven.
14.7. Independence from future versions
Publication of a new license, a new contractual arrangement, or a subsequent version of the Tool does not create a right of update, replacement, migration, or automatic access for persons holding a license for AMUKI MODULAR. Visual Construction System. Versión 0.10.
Rights relating to subsequent versions shall be governed by Clause Eleven.
14.8. Entirety of the license
This license shall be interpreted together with all of its clauses, definitions, permissions, restrictions, and supplementary provisions.
No clause shall be interpreted in isolation in a manner that expands rights expressly limited in other provisions of this license.
Clause Fifteen
15. Applicable law and jurisdiction
15.1. Applicable law
This license for AMUKI MODULAR. Visual Construction System. Versión 0.10 shall be governed by and interpreted in accordance with the laws in force in the Republic of Ecuador.
15.2. Legislation on intellectual rights
In particular, the Código Orgánico de la Economía Social de los Conocimientos, Creatividad e Innovación, originally published in Supplement to Official Register No. 899 of December 9, 2016, including its amendments currently in force, shall apply, together with any other Ecuadorian laws applicable to copyright, software, intellectual property, contracts, and protection of rights.
References to the Code shall include any amendments, modifications, replacements, or legally effective provisions applicable during the performance and interpretation of this license.
15.3. Official consultation of the legal text
For purposes of consulting and verifying the applicable legislation, the Código Orgánico de la Economía Social de los Conocimientos, Creatividad e Innovación may be consulted through the following official sources of the Ecuadorian State:

15.4. Components subject to third-party licenses
Application of Ecuadorian law to this license does not modify the conditions corresponding to the original P_2_3_6_02 code, subject to the Apache License, Version 2.0, or the licenses applicable to other third-party components used by AMUKI MODULAR. Visual Construction System. Versión 0.10.
The rights and obligations arising from such components shall continue to be governed by their respective licenses, without prejudice to any mandatory rules that may apply.
15.5. Jurisdiction
Disputes relating to the interpretation, performance, breach, termination, or application of this license that cannot be resolved directly between the parties shall be submitted to the competent judges and courts of the Republic of Ecuador, in accordance with applicable Ecuadorian rules of jurisdiction and procedure.
15.6. Mandatory rules
No provision of this license shall be interpreted so as to exclude, limit, or replace rights, obligations, guarantees, judicial jurisdiction, or liabilities that, under the laws in force in the Republic of Ecuador, are mandatory and may not be modified by agreement between the parties.
When any provision of this license conflicts with a mandatory rule, that rule shall apply only to the extent necessary, without affecting the validity of the remaining provisions of the license.
15.7. Subsequent legislative changes
Subsequent amendments to Ecuadorian law that are mandatorily applicable to AMUKI MODULAR. Visual Construction System. Versión 0.10 or to this license shall be understood to be incorporated to the extent required by the law then in force.
The incorporation of such legislative changes shall not, by itself, grant new rights of use, new functionalities, updates, subsequent versions, or other licensing arrangements for AMUKI MODULAR. Visual Construction System. Versión 0.10.

16. Language and prevailing version
16.1. Original language
This license for AMUKI MODULAR. Visual Construction System. Versión 0.10 was originally drafted in Spanish.
The Spanish text constitutes the original version of this license.
16.2. Translations
This license may be translated in whole or in part into other languages for informational, academic, or administrative purposes, or to facilitate understanding by Users whose primary language is not Spanish.
Unless Vanessa Zúñiga Tinizaray expressly establishes otherwise in writing, such translations shall not constitute independent legal versions of the license.
16.3. Precedence of the Spanish version
In the event of any discrepancy, contradiction, difference in interpretation, translation error, or divergence between the original Spanish version and any translation of this license, the official Spanish version shall prevail.
Interpretation of the conditions applicable to AMUKI MODULAR. Visual Construction System. Versión 0.10 shall be made by reference to the official Spanish text.
16.4. Official published version
The official Spanish version of the license shall be the version published on Vanessa Zúñiga Tinizaray’s official website, in accordance with Clause Fourteen:
Translations published or supplied together with AMUKI MODULAR. Visual Construction System. Versión 0.10 shall be interpreted together with that official Spanish version.
Clause Seventeen
17. Severability and preservation of the license
17.1. Invalidity or unenforceability of a provision
If any provision of this license for AMUKI MODULAR. Visual Construction System. Versión 0.10 is declared wholly or partially null, invalid, unlawful, or unenforceable by a competent authority, that circumstance shall not, by itself, affect the validity, lawfulness, or enforceability of the remaining provisions of the license.
17.2. Preservation of remaining provisions
Clauses, sections, and provisions not affected by such nullity, invalidity, or unenforceability shall remain fully effective and shall continue to have effect to the maximum extent permitted by applicable law.
17.3. Interpretation and adjustment of the affected provision
Where legally possible, the affected provision shall be interpreted or adjusted only to the extent necessary to make it valid and enforceable, seeking to preserve, to the maximum extent permitted by applicable law, the original purpose of the provision and the overall balance of this license.
17.4. No automatic expansion of rights
The nullity, invalidity, or unenforceability of a provision shall not be interpreted as an automatic grant of additional rights to the User in relation to AMUKI MODULAR. Visual Construction System. Versión 0.10, nor as a waiver by Vanessa Zúñiga Tinizaray of rights that remain validly recognized under this license or applicable law.
Clause Eighteen
18. No waiver of rights
18.1. Failure to exercise a right
Vanessa Zúñiga Tinizaray’s failure to exercise a right, delay, tolerance, or decision not to immediately require compliance with any provision of this license shall not constitute a waiver of any rights she holds in relation to AMUKI MODULAR. Visual Construction System. Versión 0.10.
18.2. No modification through tolerance
The fact that Vanessa Zúñiga Tinizaray permits, tolerates, or does not object to a particular conduct on a specific occasion shall not automatically modify the conditions of this license and may not be interpreted as a general, permanent, or future-extending authorization.
18.3. Express waiver
Any waiver of a right belonging to Vanessa Zúñiga Tinizaray must be express and in writing.
Waiver of a specific right shall not imply waiver of other rights recognized under this license or applicable law.
18.4. Partial exercise of rights
The partial, occasional, or individual exercise of a right shall not prevent its subsequent exercise or the exercise of any other right recognized in relation to AMUKI MODULAR. Visual Construction System. Versión 0.10.
18.5. Exceptional authorizations
Any exceptional authorization granted by Vanessa Zúñiga Tinizaray for a specific use of AMUKI MODULAR. Visual Construction System. Versión 0.10 shall be limited exclusively to the scope, purpose, person, modality, and conditions expressly established in that authorization.
The existence of an exceptional authorization shall not constitute precedent, a general modification of this license, or an acquired right for the beneficiary or third parties. When such authorization involves use of AMUKI MODULAR. Visual Construction System. Versión 0.10 that exceeds the scope of this individual license, it must be formalized through a specific license in accordance with the corresponding provisions of this license.
